In response to the above message for the consumer, we would like to give you the facts as we have received them from Elaine and Terry Albright of Pinion Hills, CA. After some office research, records confirm Phelan is not their real last name. A claim was initiated on September 3, 2008 for the Albrights with a claim of a vehicle knocking noise in the engine. As with all warranty companies across the US and Canada, their maintenance records were requested since the inception date of the warranty on 11-15-2006 for review and completion of their claim. On 9-23-2008, almost three weeks later, the claims department received the oil change receipts that were previously requested. It took 20 calendar days for Elaine Albright to fax these documents. This sends up a red flag, as most oil change documents are readily at hand, i.e. your glove box, in your home or at your office. History indicates when it takes longer than three to four days to receive normal auto maintenance documents they are reviewed for compliance a little closer. When Elaine sent them to us using her employer's coversheet from The Heritage School in PHELAN, CA we then received non-compliant receipts as the State of CA BAR requires. NOTICE THE INITIAL RESPONSE ON THIS WEB PAGE IS FROM TERRY PHELAN, SAME LAST NAME AND IS THE CITY OF THE SCHOOL WHERE HIS WIFE WORKS. Upon further investigation of the supplied maintenance documents from the Albrights, the claim's department was able to speak with the alleged repair facility My Auto Place Clinic @ 2672 Desota Road, El Mirage, CA, and Bob, who answered the phone on 10-22-2006 @ 5.56 EST, states that Terry Albright is his partner and this is his cell phone and they build ultra light planes at this facility. This phone call was recorded. Another call to 760-388-4736 on 10-23-2008 @ 9:01 EST has a different story. Bob now states that he used to be an auto repair facility at one time but now only does minor maintenance on vehicles and will not be open the rest of the week indicating he was sick and going to the doctors. This conversation was also recorded. If we could upload documents from the State of California website, we would for clarification. Basically, Terry Albright claims someone drove 30+/- miles to their airplane shop to do an oil change. But all of the receipts have Elaine Albright's signature on the oil change receipts. Why would you send your wife to your partner's shop that distance for her to have an oil change and then allegedly sign a non-compliant repair order? These were questions the claims department wanted answers to. According to the questionable maintenance documents that were received from Mrs. Albright from her employer's fax at The Heritage School in Phelan CA = Terry Phelan-Albright the from My Place Auto Clinic in El Mirage CA are as follows: 1. On March 15, 2007 invoice number #10796 My Place Auto Clinic the vehicle had 218,323 miles on the vehicle at that time. 2. On March 30, 2007 the State of CA Inspection station records the mileage 15 days later at 217,908. 3. The vehicle is now 15 days older but has 415 miles less on the vehicle? 4. If the numbers were rounded to the nearest 100th place maybe, but not with exact mileage from both places? In the interest of client satisfaction we asked the Albrights to produce some type of paid receipt instrument, check, debit or charge card in order to bypass the questionable mileage. At the time of this request we had no idea that these people knew each other. To date no documentation has been provided. Although prior to this initial biased report being posted by Terry Albright, we did receive one last threatening message from him through our answering service, on Tuesday October 7@6:15 PM EST he leaves the following message/instructions: Thinks your service is a scam, the next communication you get will be from the Michigan Attorney General Office. Needs tape of non call you made to his wife. Contact me if you wish to resolve this. Later that evening Tuesday October 7@9:25 PM PST Terry Albright-Phelan wrote the aforementioned article. Typically 24 hours is not an unreasonable time frame in which to respond as we are in different time zones. We had no opportunity to ask for the other payment instruments for these receipts from the Albrights again to see if in fact the questionable receipts were valid at that time. All of our calls are recorded for reasons as this. No one was conspiring in our offices to deny any claim. The Albright's documents are questionable. Further, investigations and state of CA documents proved our suspicions were correct and therefore lead to a claim denial. When attempts are made against any company to induce payments that may not be valid, costs at some time go up for everyone. The above facts are as they have been submitted to our offices by the Albrights and reviewed/checked for compliance as a normal course of claim eligibility. When the documents did not meet the criteria that the Albrights agreed and signed to do on 11-15-2006, procedure calls on their warranty registration form and this particular claim to become ineligible based on the documents that were provided to our offices by the Albrights and no one else. Sincerely, Bob Adams
