We have been banking with Bank of America since 1991 and last week they decided to deduct $300 + $70 in overdraft fees from our checking account because THEY lost my child support check. My ex-husband sent me a legal cashier's check from his credit union for child support and I deposited it on 09/03/08 and 16 days later Bank of America deducts $300 of the $400 because they could not find a digital copy of the check.

They DID NOT follow procedure and scan the check like they were supposed to. I received 2 checks from my ex-husband that day one for $100 which I cashed and BofA scanned. I deposited the $400 check, which they did not scan. The bank refused to track the check down and maintains that they did nothing wrong!!!

So our account is overdrawn by $370 and they are making us track it down! I contacted the credit union and they too are having trouble locating the cashier's check but did tell me that they matched the funds on 09/08/08 for both cashier's checks. They put a tracer on the check on their end and said it would take 24-48 hours....that was last week...today is Monday and according to the credit union they put the tracer on the check today!!! 4 days after they said they would...jackarses.

How can you only scan one check? The $100 check I cashed was the only check that they scanned and that check was deducted from the $400 deposit, thus making the $400 deposit a $300 deposit/deduction. They eff'd up royally and refuse to fix this until I can show proof I made the deposit!! How can they credit $400 to my account on the 3rd without actually making the deposit? I mean are they retarded?

So here I sit still $370 short and there they sit acting like I was the one who made the mistake. I even had the receipt and they will recognize it. "It's not good enough," they say. A little tough to make a $400 deposit disappear but BofA managed to do and screw the customer in the process.

I looked at my bank balance this morning and was hit with 3 more overdraft fees!! Now we're looking at an overdraft of $475! $175 in overdraft fees and the $300 they debited from my account because they lost the check. I got the copy of the check from the credit union on 9/29/08 and immediately faxed it to BofA. I got a call on 9/30/08 from the bank stating they got the fax and would start working on the error that was made. I said I wanted to see them remove the $175 in overdraft fees AND put my d**n money back. They had no right to touch it in the first place since the error was theirs. I received a letter from BofA on 9/29/08 stating they debited the account for $300 because of an encoding error! The encoding error occurred because someone DID NOT scan the check into the system. BofA sat idly by laughing at us while we chased down the check they haphazardly lost. We got no apology, no we'll get right on this, NOTHING!! BofA lost me as a customer forever!! What the hell are their employees getting paid to do? I mean if the customer is doing all the work for the bank employee why are we not compensated for it?
