i bank with bank of america for my business . A client of my mine had 6 old checks that had gone as NSF ( which we had given them new checks and everything was handled ) . This client had told us he had a family member that worked for bank of america and that if we ever needed something he could make it happen . Over a year later I Deposit a check which is a deposit for a job the money was to clear at 5 pm . All the checks were deposited after 5 pm by a teller . The checks were over a year old and should not have been accepted  also someone ( teller ) had been watching my bank account to know when my money was going to be available . We have been fighting with bank of america since the day after this happend it is going on 2 weeks . They are know saying the client does not want to give our money back , and told us to call the claims department ourselves ! Also they said they are not going to look into the teller looking into our account and dont want to make it right when they stole our money ! These checks were over a year old and checks expire at 6 months ! So b of a is basically letting tellers we dont know watch our acct and help steal our money with his family memember !!

You said that you deposited a check that was supposed to clear at 5pm (which as I'm sure you know, no bank can guarantee that and the days of floating checks are over), but said it shouldn't have been accepted. Are you talking about this check or one of the 6 NSF checks that you wrote before? Either way, you are right the bank should not have accepted a check that was OVER a year old (up to and including one year is fine, at the bank's discretion) but regardless it is your responsibility to make good on any negotiable item you present for deposit. The bank will act to mitigate its own loss, and yours, but if you deposit a stale-dated, post-dated, or in any way a bad check, it is on you to bring the account current should that check come back as bad/NSF/otherwise non-negotiable.

WHY didn't you ask for the old checks back when you issued the new ones? I suspect the company put the old checks in "for collections" and when there was sufficient funds in the account, the bank payed them. Years ago, I worked for a company that had something similar happen. Some d****ebag wrote us a hot check for $4,000 for a watch. After a couple of weeks, we put it in "for collections" at our bank. A month or so after that, he finally sends cash. Eight months later, the bank collects on the hot check. The funny part was the guy had lost so many brains cells, he never noticed. I see a court date in your future.
