I tried to cancel an overpriced membership at Lifetime fitness in person, but they told me that they didn't have anyone that could do that at the time even though it was 8 in the morning. I sent a certified letter to cancel the account, but just got a notice of the gym trying to charge me again.

I called Bank of America via the website number and got a Patrick in Tennessee. He was very rude, over talked me, and just kept reading from a script every time I asked him a question. I told him to get me a supervisor which he did.

Her name was Brianne, but just like Patrick, she refused to give me an operator number or anyway to identify them other than their first names. Makes it hard to make someone accountable when all you have is a first name huh?

Brianne proceeded to tell me that they WOULD NOT stop the payment and would only dispute it after it went through!!!!! What is the purpose of getting notified about a fraudulant pending payment if your bank won't stop it from going through!

I even suggested just canceling the credit card all together which they refused to do as well. For such a huge bank they're the worst I've ever done business with! Don't expect any help stopping any payments that shouldn't go through because they WILL NOT help you.

If you're response is to simply call people names instead of heeding the advice given, then you should simply go away.  You came to a PUBLIC website to post a complaint in the hope people would take its advice, except there is nothing in your complaint that resembles a rip off.  You got called out, and all you are left with is to call people names in the hopes that would somehow (lol) justify your complaint.  It doesn't.  It only deepens the lack of credibility you have.

To anyone who would read this complaint, please note there is no rip off, except by the person filing the complaint.  The filer tried to back out of a legitimate and signed contract by trying to use the CC company to weasel out of the commitment.  It's a common trick that doesn't work.  You cannot use a CC company to back out of legal contracts.

This is a PUBLIC site and just like you are allowed to post, the general public is allowed to post. Just because you don't agree with it, does not make it an invalid comment. In fact they exlained exactly why your belief of what the bank should do is incorrect.

Back to your issue, your bigger issue is probably with the Gym. It is very likely that you signed an agreement that was different than what you were "told". Unfortunatly you need to take that up with the Gym as they will just report to the bank that they have a signed agreement with you.

 The responder offered sound advice and an explanation of what is standard procedure in the industry. You just can't stand that, can you? Rather than offer some sort of point-by-point intelligent rebuttal to what he said, it's some stupid, childish remark which we've all seen here before from those who just don't have what it takes to do so and that's obvious.

Just in case you haven't realized it, this is a PUBLIC website and ANYBODY can post here. If you just can't stand that either, I highly suggest you take your toys and stomp off to your sand box so you can pout and play by yourself! Oh by the way, now's the time for you to write back saying I must work for them!

What is the purpose of getting notified about a fraudulant pending payment if your bank won't stop it from going through!  Well, the primary reason is that it isn't a fraudulent payment according to the CC company.  From their perspective, you agreed to payment with the fitness center and provided them your CC.  Then they charged you for more than what you thought you agreed to, but the bank has no documentation from anyone suggesting this.  Accordingly this situation, as you described it, would not be considered a fraudulent payment and by asking the bank to not process the payment puts them in an impossible situation.  To not follow the agreement puts them in a potential breach situation with just about every CC merchant out there.

Cancelling the card doesn't do any good either for the same reasons I stated above.

Now, as customer service indicated, you will need to file a dispute indicating that the charge was something you did not agree to with the fitness center and possibly providing evidence to confirm your story.  The center will either then provide substantive documentation verifying the charge was legit, or not provide such documentation.  If there is no documentation provided that would confirm the charges as valid, then yes the dispute will be resolved in your favor and you will receive a credit back against your card.  But if the documetation provided does indicate you owed the money, then the dispute will be rejected.
