Completed puppy application and was approved as a potential buyer of puppy, was also approved to "co-own" dog with Breeder. Put $250 deposit on Pay Pal. On 9/17/12 spoke with Paula on phone and requested that deposit be transferred to the next litter. She verbally agreed to this and informed me that I would be approximately 3rd on the waiting list for this particular breeding. Breeder informed me that I email her this request also. Conversation was very brief and friendly. At no time did she indicate that she was canceling my reservation.
After I sent the email, she replied that she was "irritated" with me for calling her on the phone versus emailing her, and that I took up too much of her time. Breeder indicated that she was exercising her right to not sell a puppy/dog to any person of her choosing.
However, at no time did her website, puppy application or contract indicate that if you call her or call her too many times or irritate her, she will cancel your reservation and refuse to refund your deposit. We only spoke 3 times on the phone. I have cell phone records to verify this. I have emails from her indicating that it is okay to call her. Additionally, her puppy blog entry from 9/24/12 at 10:14 am indicates that you can call her on the phone.
This business refuses to provide aforementioned service (sell dog) to consumer because consumer irritates business but then refuses to refund deposit. Also, Breeder refuses to clarify what circumstances warrant a refusal to sell the pet since she did approve me as an pet owner initially and even offered to 'co-own" a dog with me.

We actually refunded the deposit (non-refundable) to the customer. Also, BBB in all cases have agreed we Barefoot Pudels breeder were in the right and validate our contract.
We always reserve the right to not sell a puppies to anyone. We do have a puppy application that help us sort out potential owners sometimes after speaking to people on the phone we get a better idea of who they are (rarely) we change our mind due to their actions and refuse to sell them a puppy. So the only thing they can do is to post fraudulant web pages. Feel free to conact us and ask any questions.

After going to the Better Business Bureau in California, this issue has been resolved to my satisfaction. Please do your research and check references BEFORE you put a deposit down and make sure that your personality style and method of communication is compatible with the breeder's. You will avoid a lot of grief when you are both on the same page.
