My partner bought a truck, a 1999 Nissan Frontier. She did her loan application with the dealership but due to the short length of time at her job they asked me to cosign for her. I didn't find until after everything was said and done that I was the only person on the loan. My partner has severe ADHD and isn't always the easiest person to deal with in situations like this. I feel that the car dealer was losing patience with her and just felt that having me sign the loan papers instead would be easier for him. It was all very confusing. In any case she liked the truck the first couple of weeks she had it. The dealership told us the truck was in excellent shape and had no rust at all despite its age. On appearance there didn't seem to be any rust. Then it started to smell weird. I had the  oil and fluids checked and it seemed fine. Then the parking brake light came on but it seemed like it was just the light and not actually a brake issue. I informed the dealership and told them that we would bring it in when we could get to Syracuse (1.5 hrs away) as soon as possible. On December 29th the brakes just went out in traffic in downtown Ithaca. We slid between two cars damaging the door of the truck substantially. We were lucky no one was killed during that accident. We live up in the hills of Newfield and could have gone over one of the many high cliffs driving. We had to have the truck towed to Midas. After inspection at Midas we were told that the truck was so badly rusted underneath that the repairs to the brakes alone would be $1200. They said the dealership should have NEVER sold the truck in this condition. It wasn't safe and obviously they didn't truly inspect it. They also said that the steering column needed to be replaced and that was an additional safety problem and it couldn't be resold to us in this condition. We paid to have the front brakes fixed because we had to work. I informed the dealership and they agreed to fix it the rest of the brake issue when we had time to get it to them. I explained it  would be awhile because we were extremely busy and a day off wasn't possible. Every time I made an appointment to drive to Syracuse the weather was bad. With the brakes not good we were afraid to drive it on the highways. On March 15th the truck started smoking. We took itto Mobile to have the oil checked. They said the truck was basically such a mess they couldn't even tell us what was wrong with it. They asked us where we got it, when and how much we paid and when we told  them they looked at us shocked and said the dealership sold us a lemon. The whole inside of the engine was full of old and new oil. The frame is rusted so bad it is on the verge of freezing up. They said they think the engine is about to go. It is leaking oil badly. I again contacted the dealer and told them they really needed to tow it to Syracuse to repair not just the steering and the brakes but whatever the engine problem was. They basically told me no. They said if we drove it to Syracuse (impossible as is) they would see what they could do but the financial obligation was ours.

We are paying over $9000 for a truck that drove for less than a month. We can't work without a vehicle. We are poor people as it is. This will totally devastate us. I feel the dealership is shady and knew they were selling us a bad truck for 5xs it's value. Mobile showed us the blue book value and it was $1500 for a truck in fair condition with the same mileage. This truck isn't even in fair condition. We were totally taken advantage of. I have contacted the loan company and they are also investigating. We don't know what to do. All we want is a working vehicle for our money. We will accept a trade of the same value as our loan. Or if repairs can be done and guaranteed we will accept that as well. We have kept them informed all along of the issues. I understand that it has been over a month but given the amount the gauged us for the truck, the existing problems and the total lack of regard for our safety and convenience I believe the dealership is at fault.

Jacqueline Phelps purchased a 1999 Nissan Frontier on 10/14/2015.  The purchase price was $5995.00 and the vehicle had 109,915 miles on the date of delivery.  On 12/30/2015 we received the first notice of any issues with the vehicle.  It appears a brake line had broken.  We received an email stating that she had the vehicle repaired and there was a couple other possible issues.  The Midas receipt that was sent with this email shows the vehicle with 114,238 miles.  The vehicle had already been driven 4,323 miles at this point.  At this time we set Jacqueline up with an appointment with our service department for 1/11/2016.  At 12:12pm on 1/11/2016 we received another email stating that she could not bring the vehicle due to illness.  That was the last we heard from Jacqueline until another email arrived 3/14/2016.  Along with this email was an oil change receipt showing 116,879 miles on the vehicle.  The vehicle has now been driven 6,964 miles since it was purchased.  The vehicle is long past any warranty coverage that we offer.  We did however offer to give a fair estimate to repair anything the vehicle might need.

The point is that you knowingly sold a truck that is a piece of junk and REFUSE to fix it. We told you about the problems. You are in Syracuse and we are in Ithaca. I suppose we should have taken a couple of days off and camped out at your office until you fixed it. The emergency brake light flashed on and off. It's an old truck. It wasn't like it drove differently until the day the brakes just totally failed due to your negligence. Midas said you clearly got the brake system to work well enough to drive for a month until the parts all froze up from rust. You could have killed us! Does that matter? I am not a mechanic. We gave you all the information to talk to the mechanics we went to locally who said you clearly ripped us off. We sent you the documents. The steering column has apparently been messed up for a long time, long before we bought it. Something surely your mechanic looked at before reselling? How did it ever pass inspection, the great mystery? How can a business knowingly take advantage of people like that? We have nothing. Because of this we will lose our jobs. We don't have money to fix all the problems this truck has. Who expects to buy a truck for that amount to only be able to drive it for four months??? You should be ashamed of yourselves. It is unethical to sell a vehicle for that amount in that condition. We trusted you because it looked nice on the outside and your sales person seemed so honest, telling us if there are any issues you always work with people. Basically what you are saying is we shouldn’t have trusted you and neither should anyone else because you will take advantage of people if given a half a chance? We will go to the ends of the earth to tell everyone what you have done. We contacted the loan company, every government agency and a lawyer.

And NO with all the chaos in your office that day I didn’t realize it was just in my name alone. It was her truck. I assumed I was a co-signer, so did she. Not that it’s a big deal. We are not planning to split up. Just noting you could have made the details a little more clear. You slid it by just like you slid by the fact that the truck was completely rusted out underneath and would not last much longer. I remember your sales guy saying over and over “There’s no rust on this and low miles!”

If you would just fix the problems that clearly are pre-existing before purchase we would be happily on our way. Is that so difficult? The amount of money you made off the sale should be enough to cover at least that. Think of the lawsuit you’d be facing if we had been hurt or killed the day the brakes failed. This truck is a cancer in our life!

How did you NOT KNOW the only person on the loan application was you???  Did you even bother to READ what you were signing BEFORE to you signed it?  Then you wail about value.  The time to consider the price versus value matter is BEFORE you obligate yourself to the contractual terms!  How hard is THAT to understand???  The mechanical matters...did you even bother to test drive the car?  You say the brake light came on.  Where did you ever come up with this idea its OK to ignore that light???  You chose to drive the car when there was an indication of a problem in the brake system.  A reasonable person would not have done that.
