We'll all just meet in small claims court with the OP. Either it's damaged or its not, it's within the return policy or its not. I'll avoid the barbs and arrows otherwise.

Yes.. I would have to agree with the MORONS who have replied to this report.....I can not fathom the possiblity that someone has ever dropped a lap top. no chance..this is ALL Best Buys fault. They put butter on all the laptops so some assmunch will drop it...and then when they come into the store will throw it back at the consumer and say...."go talk to Steve...he is the EXPERT on BestBuy policy".

If you returned it within the return policy period, and there is NO sign of physical abuse, you have every right to return it for a refund. Take a picture. You can prove you were there within the return policy period from their cameras if you had to.
File a complaint with your State Attorney General's Office to put pressure on. Call BBY corporate, Office of the Chief Counsel Joseph Joyce - you'll speak to a Sec'y - that's all you need - give the facts and that you've filed a complaint with the AG. You'll get action.

First of all, the Geek Squad is mainly incompetent. Geek Squad sucks. Idiots. Losers. They couldn't identify a defect in a push broom, much less an electronic item.
Second, the Geek Squad has NO AUTHORITY to tell you anything as far as what will or will not be done at best Buy, or with a refund or exchange. Talk to the General Manager of that store in person.
Here are some suggestions.
First option, if you paid with a credit card simply dispute the charge for the defective product. Get a refund, and go shop somewhere else.
Second option, call Toshiba directly, as that unit is under factory warranty.
Third option, call the corporate offices of Best Buy and file a complaint.
And, most of all, remember to NEVER shop at Best Buy again!!
