Beyond Fitness Fraudulently accepted member fees but never opened the gym - no refund 18 months later Cary North Carolina
I am yet another victim in the Beyond Fitness fiasco in North Carolina and other states. Eighteen months ago, I pre-paid for a 2-year membership for a gym that was to open in 4 months. The date kept getting delayed, until it became obvious that the gym would never open.
We were all told that the gym would come under new management and the membership contracts would be honored. No new management, no gym. The state district attorney's office was beseiged with complaints.
I was told by the Beyond Fitness "billing service" (not part of Beyond Fitness, just "paid" to handle their billings and complaints) to send a registered letter requesting a full refund, which would take up to 30 days to prepare and mail. Letter delivered in June. It's now August and no refund.
The Cary, NC phone number ("headquarters" according to the billing service) is an answering service which cannot accept any messages because the message queue is "full" 24/7. The "Billing service" reports that they recevieved my request for a refund and forwarded the message to Beyond Fitness HQ.
Final note: there are still Beyond Fitness gyms open in NC, so income is being generated. Perhaps it's time for a class action law suit...

I reside in the Triangle are of NC. I have done extensive research on Beyond Fitness and Randall Rohm, et al and have acquired a massive file. Also, I have had direct and on-going correspondence regarding this situation with a couple of local reporters in my area. The telephone number given in the lastest news reoprt 08/02/2006 via the Better Business Bureau appears to be not much more than a message center for those who desire a refund. Who knows how long this can take. For those of you who are having difficulting with receiving any co-operation from Beyond Fitness's collection agency, Aphelion, Inc., pehaps, I can help. Last week, I was able help a Beyond Fitness victim have past due billings discharged, along with a cancelled membership. Each case/situation is different, but if you would like to wend me the details of your story, I may be able to resolve your situation. If not, I will add your story to those that I am compiling for a local reporter in my area. ((( email redacted by ROR))) For those of you from the Raleigh/Durham/Chapel Hill area of NC, it is advised that you do not join or utilize any Beyond Fitness membership at the locations, now called, "So-Fit" aka "Southern Fitness", at this time.

The troubleshooter at WTVD.com has been all over this Beyond Fitness mess. Copied and pasted: Many people ask about the Wake Forest Beyond Fitness that never opened. Members there were promised refunds and some still have not received those refunds. According to the N.C. Attorney General's Office, they are aware that Beyond Fitness is under new ownership and say the new owners have set up a process for those people to get a refund within 30 days. Members can call 1-800-856-1232 for details. Good luck!

While it is frustrating that this particular gym in question did not open as planned, Beyond Fitness does have numerous other gyms in the area and your membership entitles you to use any of the other locations. Looking at their web site, there is a location in north Raleigh that is quite close to Wake Forest. Why not utilize your prepaid membership by working out at this location instead?
