I worked for Big 5 for nearly a year and was an assistant manager before being terminated. I learned how to operate the store from the other managers that worked there. We are not suppose to give our keys to other employees but every manager there does it.

I got a phone call from another manager who said she got talked to in the office about giving her keys to employees. A few days later I was also called into the office and it started off the same. All of the sudden they were talking about suspending me and I was told to take a break. They call me back in 10 minutes later and I was told I could quit and use them as a good reference or be suspended and not have a good reference...is that legal?

The other manager who got talked to was soon promoted. I was the only one to have to quit because of this. While in the office I asked to have my termination paper so I could fill in some comments. I was told that the paper work was not necessary and that it was time for me to leave. There is video of all of this stuff taking place. My real problem is everyone else did the same thing, some did worst than that and I am the only one to be forced to quit.

I also know of another manager who was sleeping with a cashier and favoring her. The district manager was told about this but no actions were taken against him. Another huge issue is in our store one of our guys who works behind the gun counter would come to work drunk. We caught him doing it on his break but nothing was done about this. That is a very dangerous to have someone drunk working the gun section.

I want to know if I have a case against them, there is proof in the video from the store. Please let me know what you think or what your take on any of this is.

I work in a completely different area, and am an assistant manager myself. Yes I have seen unfair things take place, I have seen store managers get fired for minor infractions and trainees last and last while violating just about every policy in existence. I would however suggest you not sue. Big 5 is great at beating people in court, yes you have a case, but I have seen people do far worse than hand keys to a part-timer and not get fired. I had one store manager who would work part-timers off the clock, and another who would consistently berate his full-time staff, and another store manager who hated male employees, and outright tried to get one of the assistants transferred only months after she was promoted. I am guessing I'm not hearing the whole story, in your case though. Was a firearm stolen while your keys were out? Was the office gotten into while your keys were out? I mean even I have done far far far worse than give out my keys, I have committed one of the few "major" violations that take only 2 instances to get you termed. The main issue I see here is that they didn't allow you to fill out comments on the term form, and that this took place in a California store, where labor laws are strict as hell. If you could provide a list of all write-ups you received and all complaints you made about other employees during your entire career that would help me to know if you had a case or not.
