We rented videos from a Blockbuster franchise we don't visit often and subsequently returned the videos late. We got the card in the mail regarding the fees and had every intention on paying them however before we even had a chance the charges appeared on my bank statement.

I have been told that when you sign the membership agreement (it's my husband's he created before we got married) that you give them a credit card number and agree to them charging on it, but our bank account is a joint account and neither one of us has ever authorized them access to it. Can they legally take from our account without our permission? We have never had this happen to us with our "regular use" Blockbuster.

That is absolutely justified. you are giving Blockbuster the LEGAL RIGHT to charge you for THEIR PROPERTY

Yes, when you SIGN the rental agreement (which is a CONTRACT) you are giving Blockbuster the LEGAL RIGHT to charge you for THEIR PROPERTY when you FAIL to return it on time. They first send out those reminder cards and if you still FAIL to return their property, they WILL charge you and you deserve to be charged. They have NO way of knowing whether you ever plan on returning the rental if you FAIL to do so by the date it is due. Blockbuster doesn't pay much more than minimum wage and I seriously DOUBT that the employees are qualified to READ YOUR MIND. They have NO CLUE if you will return it or not and for all they know, you could keep it and NEVER return it. I'm sure you had "every intention" to return the rental, but there is NO way Blockbuster can know your intentions. ;) They absolutely DO have the right to charge your card and they SHOULD if you FAIL to return their property, thereby BREACHING the contract you SIGNED. If you didn't understand it, you SHOULDN'T HAVE SIGNED.
