Well, I just hung up with a nice enough rep from NCS. I explained that I just checked my credit report with Experian and found a collection from this agency. I also explained that I am a victim of identity theft, since I was 13 years old. So naturally, this is very upsetting for me.



She explained that this account was reported from BMG, some sort of cd/dvd store? Apparently, in 2004 I had ordered cds/dvds for A PENNY (imagine that) and I now owe 199.00. I asked for proof that I had done that and was told the proof is that my name & address were provided. Since I received mail at that address, I must have been the one to order the product.



She went on to explain that sadly, that is all anybody needs to provide. No signature, no ssn or proof of identification. When I asked why in 6 years I never received a phone call or a letter from either her agency or BMG, she stated that "Yes, a letter requesting payment would be appropriate but it is not required". 



So now, 6 years after somebody ordered cd's (could have been anybody, neighbors, siblings, ect) I am being penalized. My credit score is down, my interest rate has gone up and now my fall student loans may be denied.



But wait, if I pay the 199.00 just because somebody claims I owe an outstanding balance, it MIGHT be removed from my account. OR I could some how, go on a man-hunt for whoever ordered these cds and file a police report.



My next step is to hire a lawyer and hope that this is resolved before my fall semester.

You were told someting false by NCS.  They previous poster is 100% correct.  Proper validation is NOT them saying that the address they have on file is correct.  They must provide a sign document with your signature and terms that you ageeed to pay.  NCS is known for ducking nd dodging people that say the account is not theirs and pushing for them to pay.  Look at all my replies to people on here aboiut NCS.  I am even attacked verbally by Bob Anderson for suing them, winning and then plastering help and details ALL OVER the web and my own website.  Write them a form letter disputing the debt as not your and demand prope validation.  I will be more than happy to send you a copy of a legal form letter with law quotations included from the FCRA and FDPCA to help you out.  Feel free also to visit email me and I will share with you by consumer protection website.  I was recently interviewed by a major Washington DC law firm for my work against NCS and other bad businesses.  I take no money and ask for none in return for my help.  My picture is weven on my website.  I am not hiding as they claim at times.  Let me know what I can do to help.  Never call these scumbags and never sign a letter or document to them.  They are known to record conversations and edit them and to scan in signatures to falsify documents for court dates.  Best of luck.  Go get em.

The fact your address is correct is NOT legally sufficient validation of the debt. That is complete BS. They MUST provide a contract,signed by you, or audio recording of your voice consenting to the BMG membership. On the audio recording thing, be VERY careful what you say to these folks (or better yet don't talk to them at all...see my final comment) b/c they will mess with the audio to "create" a tape of you "consenting."
