Bob Wayne's Guranteed Upholstery Shop ripoff breach contract fraudulent billing scam report paid full deposit partial work done no refund Haddonfield, Bala Cynwyd New Jersey, Pennsylvania
Need to upholster 16 dining/meeting room chairs, so called the only upholstery ad in the local paper. number forwarded to a cell phone that is 'temporary out of service'. A few days later, got on hold of Bob Wayne, head of co., told him to bring over microsuede in beige color, set up estimate appointment.
A saleswoman Marilyn Benedict came over April 1 an hour late. Quickly decide on color and material since i've in mind already. She quoted $280 for 6 chairs, $180 for the other 10. question if the 6 can be cheaper using existing foam, reason i don't want to pay similar as i can buy brand new ones. She agreed right away, 'i give 10 for $180 too.' so we head over contract, 10 with 1 material 1 color reupholstery, 6 with another brand same material another color just recover using existing foam. total $2880, deliver date May 2. 1000 deposit paid upon signing contract to show commitment and for order materials from 3rd party supplier. exchanged phone number, chatted about hobby, life maybe future business etc.
A few days later, Bob Wayne called to set up pick up chairs. i asked on phone 'is my price fair?' since i did not shop around, she agreed $100 discount so quickyly, and my internet research on new chairs can be as low as $150. 'you got a good price,' he said.
A few days later, his people came to pick up the chairs i left at back yard as i had to go out of town for emergent errands. left phone number in advance in case corp. trouble for coming to my property. he took 13 instead with no call no messages. i left 4 messages when i got home notice 3 chairs left unpicked. till last message request all work pause before a clear answer, then his people replied truck too small will pick up coming Monday.
Monday Bob Wayne did come with worker and got the rest 3 chairs. 1st time i met him, i politely greeted him.
2 weeks later he called, 10 chairs are ready, came out nice, he wanted $1000. at the set time, he showed up with worker, delivered the other 6 chairs instead. husband unwilling to pay $1000 since no 10 chairs but 6, i gave him $800 he OKed and signed on paper, paid $1000, balance $1080. i told him 'let me know when the other 10 chairs are ready.' he nodded.
May 2, no call, no messages, no seen chairs. a few days later, i called left message: 'very important person coming this weekend (i'm referring to mom for Mother's Day), what's the status of chairs? quality 1st priority.' no reply, May 9th Monday night when me and husband came back from work, 10 chairs sitting at back yard as original, nothing done. called a few times, just voice messages. A few days later, got hold of him saying 'they can't be uphosltered, i won't refund you. don't call, i will hang up.' then he rudely tell me 'are you idiot? i redid the foam sorry without inform and your consent, i ordered the material that can't be used someone else. if you have mental problem, my wife has psychology practice. this is American way. my way of doing business. you don't like, go back to Vietnam.'
At the end, i don't have chairs for the important event. paid $300 rather than agreed contracted $180 for 6 chairs, more than new chairs i can get for no more than $250. paid deposit for materials without having them not to say finished 10 chairs. contracted breached and delivery delayed. got verbal humilated. He stepped on my property without notification. left messages to ask refund of $720 difference as contract term 'undone work or delay has option for full refund', never answer.
Today is a month later June 2, we're filing lawsuit against him. I called up a few more upholstery shops from yellow pages, so far i got 2 estimates, written confirmed me that the 10 chairs can be upholstered. both chairs are quoted at much cheaper price than Bob Wayne charges.
Bob Wayne will be punished American way he deserves. I recommend everyone don't deal business with him. Further research i noticed he had bad unsatisfactory record due to answered complaints years ago. He did this again on me. Let's stop him.
