Purchased 3 month old Cocker Spaniel puppy from Brushy Creek Kennel, David Moore. The puppy was very sick and I took him to the vet the next day, per the contract. The vet said he had 2 bacterial infections, one severe intestinal infection and one upper respiratory infection. The puppy was so sick they thought he might die. The vet also thought he might have distemper. The puppy is severely anemic.

I called Mr. Moore who refused to reimburse me for the vet bills. He said to return the dog to him and he would have "His Vet" get him better and then I could pick him up once he was healthy. I was afraid that if I returned the puppy to him, I would never see him again. Per his contract, he is obligated to give me another dog.

I do not want another dog from this man. The types of infections that the puppy has are contagious; which means the rest of his puppies probably have the same thing. Next, my other dog which I have had for 14 years, caught the infections that the puppy had. She had to go to the vet and is now on the antibiotics that the puppy is on.

I spend $395.00 on the cocker spaniel puppy and now have spent close to $500.00 on vet bills which Mr. Moore refused to pay me back for. He has yet to send me the registration papers on the puppy either. When I called him regarding these issues, his response was that he was offended by my accusations.

Well, I am offended that I have spent $395.00 on a supposed registered puppy; then another $500.00 on sick vet bills from your kennel. If he truly guarenteed his puppies, he should be willing to cover the expense of the bills.

Mr. Moore, your contract was void with the 48 hours vet check and my dog had 2 bacterial infections. Had I returned the puppy to you, you would have sold it to someone else and received more money. Either that or the puppy would have died. Luckily, I saved it's life. You are a fraud and a crook. You need to be shut down. You have what is coming to you. Your words are nothing but lies. You specifically told me you would reimburse that first vet bill and you never did. You and your puppy mill are nothing but unethical. If you were an honest, ethical man, you would honor your customers. The fact that you have now been sued and that people from all over the United States have bought dogs from you that have been sick should tell you something.

the registration papers? You did not address that in your rebuttal. I know your reputation and it is terrible. You are a bona fide puppy mill, you breed sub par, sickly dogs for money and you don't care about the animals or your customers at all. I believe at one time you said you like to sell to families, because the kids get attached quickly and then the people won't bring the dog back for a replacement, as per your so called guarantee, therefore letting you off the hook for your sickly dogs. Shame on you. Isn't some newspaper or something doing an expose on your horrific operation?

When the puppy left my home he appeared to be quite fine. I do have a contract and you signed it. I stood behind it and you didn't like it. If you don't like what you are signing don't sign it. If a puppy looks like it is going to die then don't buy it. My contract states I do not pay vet bills. It also says you can return the dog for a replacement. YOU CHOSE NOT TO DO THAT.
