First let me tell you that I am a seller with over over 800 positive feedbacks, 200 of those came from purchases I made. I recently purchased 2 video games for my daughter from a seller with over 75,000 feedback.

After 3 weeks the item had still not come so I contacted the seller and asked for the shipping info. He gave me a confirmation # showing it delivered to an adress I have never even seen! I asked him how could this be, my paypal info has the correct adress. This seller (with 75,000 feedback mind) called me a liar and threatened to report ME for fraud.

Well I contacted Paypal by phone and told that the seller was not covered under the seller protection program because he did not ship to my confrimed adress as stated in the paypal payment and to go ahead and file an item not received report. After I opened the report the claim was denied in a matter of hours (yes I said HOURS paypal CAN work fast when they feel like it.) Of course I contacted them again and reopened my claim only to have it immediatley denied once again. Third time the same.

Meanwhile I have been contacting the seller (always using professionalism and tact)only to be insulted and told that he knows several paypal and e-bay executives and that is why my claim will not be taken seriously. I have also requested the sellers contact information 4 times so that I may personally file a lost package form with the postal service (so I can find out where it really is) only to be completley ignored.

So so far I have been ridiculed and called names by a seller, ignored by e-bay and paypal just turns their heads. Most importantly, I am out my money!!!

Well I will admit that I made 1 stupid mistake, when I checked the seller's feedback I only noticed that it was a 99.4%, but I wasn't thinking that when you have 75,000 feedbacks and only a 99.4% it means you have received 500 negative feedback. Now I will admit that in that many transactions a seller will pick up a few negatives, but 500? That's alot of unhappy people.

When I read some of the negative comments I understood that this guy was a totally rude, unprofessional, tactless jerk. Every one of his negative comments had a reply with some smart a-- remark and a slew of insults. He always has to get the last word.

Of course everyone knows that paypal and e-bay are already known to be an absolute RIP OFF, it makes it rather difficult for sellers to make any money (that doesn't mean they should rip off their customers though.)

My advice to anyone would be to pick a reputable seller (ie. if the seller has ticked off 500 people avoid them completly,) don't expect that paypal is going to offer you ANY protection in any way, even if you follow their rules to a T (that goes for buyers and sellers,) and keep your eyes open for the next class action lawsuit against paypal because I'm sure that there's another one just around the corner.

P.S. The seller in question is budgetvideogames, his name is Steve, and it's best to just avoid him altogether.

I am a fairly experienced buyer. I have been with EBay for roughly 5 years.

I also should have reviewed this users feedback before buying. 99.4% sounds good but with as much as he sells it means a whole lot of negatives.

As I said I have been with EBay for roughly 5 years and have never had a problem. I've had items shipped late, items out of stock and i've even had items that didnt work and the sellars were always willing to work something out.

All of a sudden I purchase something from 1busyman and when I go to check out using "1busyman's mareket place checkout" it show I have made a double purchase and purchased two of the same thing? How this happens I have no idea.

So I contact the seller explain that some how I received two of the same item when I only purchased one. I asked him if he could adjust the order to reflect what i had purchased.

He responded that he will alter the invoice. Excellent.. Problem solved; or not.

Then he sends me this from his own FAQs:

Specifically the part that reads:

"I ordered the wrong item or I accidentally show 2 or more of same item won.

As per ebay stated rules and policies which all buyers acknowledged understanding of an acceptance of when they first registered on ebay all bids are binding contracts and cannot be cancelled. Now ebay customer service reps will often tell ebay buyers to contact sellers ask ask for a mutual withdrawal of sale. What they usually fail to tell buyers is this is totally optional for sellers and if accepted it is a time consuming manual task and seller loses money in the form of no listing fees are reimbursed and again it is a manual task and time consuming. Plus ebay system does not allow for a seller simply to close sale and it requires buyers acceptance after it is requested, so we now would be dependent on buyers following through and we will not take this chance as it would have to be manually tracked. So please do not contact us asking for a mutual withdrawal of sale as we never will accept this option. Anyway if you bought 2 or more of the same item, or bought an item you no longer desire or simply made a mistake please do not contact us or email us as there is nothing we can do about it. However in these cases we will allow buyers to switch items out for one of equal or lesser value. Please look through our other items for sale and when you find an item you desire here is what you will need to do. In our checkout system there is a notes section where buyer can leave us a note. The notes section is in the same area as you input your name and address. Here leave us a note to switch out item for another desired item or item of equal or lesser value and we will accommodate you. You do this in our checkout systems notes section and not in the paypal notes section. we do not read or even see notes left in paypal or ebay systems, only our checkout system so be certain you leave this note in our system. Bottom line if you won item you will need to pay for every item won or our system will automatically file unpaid item strikes with ebay and there is no exceptions to our policy except for one stated above where we allow you to swap item for another. "

What the guy is doing is if you buy 1 item he charges you for two and then when you tell him you only ordered one he makes you pay for it or buy something else from him.

This is fraud and obviously happens often with this seller if he has to put it in his own FAQ's. If you refuse to pay for the item you never ordered he reports you to ebay.

Botttom line here, buyer is lying. The item was shipped to buyers confirmed address with paypal and received and signed for within days by buyer. Hence ebay and paypal denied these false claims. In fact we ship all items insured and unfortunately a few bad buyers who try to get merchandise for free file false claims. The vast majority of buyers and sellers are good and honest. This buyer is not

If you don't have a posting ID, get one and convey your problems to the message board at Ebay Community. Lots of experience buyers and sellers there who will give you good suggestions. BUT... DO NOT USE YOUR REGULAR EBAY ID. OBTAIN A NEW ID TO USE FOR POSTING TO MESSAGE BOARDS ONLY!

To answer some on the questions I have received. The adress the seller sent to dosen't even exist, I have run it on mapquest and yahoo maps and there is no record of it. I too have purchased items from this particular seller in the past with no issues. Yes, I do have a confirmed adress, it states on my paypal payment that the seller should ship to my adress, which is confirmed. That's why I am so confused, I am covered by paypal's buyer protection policy. I think that paypal is just protecting a big seller because he is a money maker for them.

I took the time to look over some of the feedback left for the seller. Most of the complaints I read seem to deal with his attitude and items not being received or not working properly if they have been received. There's also so negatives that complain about slow shipping. Percentage doesn't matter to me as much as what the complaints are about. This seller has a definite pattern in his feedback. Be prepared for a retaliatory negative if you leave him one, that's also part of his pattern. Not that it will do any good, but you may want to consider making a complaint to the BBB. Do what you would if this were a brick and mortar business that wronged you. I have serious doubts that Paypal or eBay will do anything to help you because they make their money off sellers listing stuff-----not bidders bidding. I would also post this report on every consumer advocacy site that you can think of. You may not get your money back or your item, but at least you'll have the satisfaction of knowing that you have smeared this guys reputation somewhat. Start with consumeraffairs.org and baddealings. Just google consumer complaints and post to every site that comes up. I never do business with power sellers because of what you've posted. Most are rude and have too much business to handle it properly. I will also be emailing this seller to let him know that I won't be doing business with him because of what you have posted here. There are email links on his About Me page along with a link to his business on the web.

That I was really surprised by your posting. I've done business with 1busyman, and truthfully, I'm one of the 99.4% that was very happy with his service. He shipped promptly (in fact, I rec'd the package sooner than expected), and the product (a GBA game) was in perfect condition. I'm both a seller and a buyer on ebay, and the problems that I've experienced are minimal. Could you please expand on your posting... ie:how was the package sent (USPS, UPS, etc), was the address even close to yours, if you have a confirmed address, and the package (per their records) was drastically different, were there no questions asked? I'm curious to know in the interest of future personal protection. I appreciate your time in letting others know about problems such as these, since the internet has now become 'let the buyer beware', if a good seller has gone bad, any information is good information! Thanks again, and I look forward to your next update.
