House was listed by Lynn Cain Cooper for $179,000. We submitted an offer for the residence and a counter was given. Mrs. Lynn Cain Cooper text messaged my realtor to let him know that she had listed the property with incorrect square footage and that the owner would not be moving far from their asking about. My realtor asked for a copy of that survey with the new area at that point. We still replied to their counter Saturday(2/06) morning at 9:36 am over the phone to AGREE to the counter, even without the survey.

3 hours later Mrs. Lynn Cain Cooper text messaged my realtor to withdraw the counter and that there was another offer, then to bring our best offer forward. My realtor called his broker, who in turn called Lynn's broker(her father, Hubert Cain). He said the counter was void because of the text and that we needed to sent another offer. The original counter was signed by us and sent at 1:45 when we had till 5:00 to respond.

NO written cancellation was ever sent by the realtor signed by the seller. Not agreeing that this is fair, but can not do anything else, we send another offer. Hubert Cain then calls my realtor's broker to ask for an extension till Monday. My realtor calls Mr. Hubert Cain to state that we would give 24 hours, but till Monday shouldn't be needed. Mr. Hubert Cain then stated the HE needed till Monday to get things straight and also admitted that there WAS a verbal agreement to the original counter presented by the sellers and their realtor(Mrs. Lynn Cain Cooper).

Monday(2/08) Lynn Cain Cooper calls my realtor to state that she now wants to present the second offer we submitted to the sellers, but wants us to sign a waiver acknowledging the first counter was void. This sounds like she is now trying to cover herself of the unethical wrong doing of the first offer. And all of this over a house we truly wanted and would have paid more for, but never knew what the owner wanted from us because of the realtor. They denied our second offer in fear that we would sue.
