My husband and I bought our Chevrolet Venture minivan in December 2005. I have had some medical bills the last 6 months that prevented me from making on time to the day payments on my car. Please note my payment is $518.00/month on a $19000 loan. I have been making payments to them and I admit to being 29 days delinquent here and there. But they have recently been calling my employer DAY AND NIGHT NON STOP!! Both my husband and I work for a government agency and this is not tolerated or allowed by law due tot eh fact we deal with military issues. I was recently informed by my husband's supervisor that they have been calling repeatedly during the night shift on his phone. My husband does not work nights. We both work the day shift. His supervisor was quite polite about it and told us of the capital one harassment website to report to. He informed me that because we deal with miltary issues and could be a terrorist target, the FBI can track repeated telephone numbers and a report can be given to me in regards to the number of times they called. This report will be retrieved when I can locate an attorney to sue them for harassment. When I called Capital One in regards to their harassment, they said that 17 calls in 3 hours was within their legal right. Umm.. no it is not. They have been calling my home all day starting at 7:30 a.m. until almost 10 pm CST. My satellite company also does my caler id so I am able to see how many times daily they have called. It is amazing how stupid they think people are. They try to call in using their supervisors' name(s), just so I will answer the telephone. I recently made a payment of $514.95 over the telephone and scheduled it for 01/11/2008. I told them that the money would not be available until then. They graciously took it out on 01/07/2008 causing $280.00 in overdraft fees. My banker told me to file a discrepancy, which I did. I also filed a discrepancy with Capital One. It took them 2 weeks to come back and tell me they were'nt responsible for the overdraft fees and I could just and I quote "Deal with it". They stated they had no record of the postdated payment for the 01/11/2008, how convenient. I didn't get a confirmation of the telephone payment until yesterday, stating I ok'd it for 01/07/2008. I will no longer make payment arrangements with them over the telephone. I guess, they will get their money, when they get it. I am to the point where they can come get the car if it means that much to them that they have to harass my 11 yr old son over the telephone. Any suggestions anyone? Does anyone else smell a class action lawsuit against them?
