Banks make what are called soft inquiries all the time, and the only person who can see soft inquiries on your credit reports is YOU (okay, and the wage slave who might prepare the report and stick it in the mail). The only inquiries that are factored into your credit score are hard inquiries, which are inquiries that are a result of you applying for credit and a bank or other entity doing a true credit check. I have tons of soft inquiries from all kinds of credit card companies on all three of my reports, and they don't affect anything. Since I've seen it myself, that's what I'm guessing is happening with you. A bank doesn't have to have your permission to do a soft inquiry, so your legal battle is probably going to be fruitless. Check with Experian, Equifax and TransUnion and they'll tell you the same thing.
