22 months ago I aplied for a loan with cash call. I had recently been on medical leave and did not have the money to attend my brother's wedding.

I was approved and the gentleman was polite however he never discussed terms of the loan until we had agreed to the loan. He sent the documents to my email address and it was then that I saw the interet rate. 87 percent.

I took the loan because I needed to be at my brother's wedding I was his best man.

I have paid on time for the last 20 months nearly $200.00 per month on a $2500.00 loan. I missed my last payment and AFTER 20 months of nearly $200.00 per month I found I owe $2600.00 on a $2500.00 loan!

I have spoke with several representatives finally with a Ms. Berry. I asked to settle the loan for $1800.00 and Cash Call refused. I expressed if Cash Call could not settle for $1800.00 I would need to report them to the appropriate authorities.

Ms. Berry turned this statement around on me and said I was threatening Cash Call. This statement was not a threat just business practice, however Ms. Berry said I was taking this too personal and it was just business.

Ms. Berry explained that California has given Cash Call a business license and if I had a problem with anyone it should be California NOT Cash Call. I explained that many times in history our legislative bodies have passed laws that later they regret and repealed.

Based upon cash call's behavior in this matter and upon the fact I have already paid nearly $4000.00 on a $2500.00 loan I am filing this complaint and I believe many other people must have the same issue.

I checked the box for a consumer advocate to contact me. I have contacted the Attorney Generals office of New Mexico and I have contacted a layer in New Mexico. It is my intent should this matter not be resolved immediately to pursue legal action against Cash Call to prevent any further business transactions in New Mexico.

Should anyone else desire to do the same I ask them to either contact their state's Attorney General or if you are in New Mexico please contact Mr. King's office at www.ago.state.nm.us

Please understand I attempted to settle with Cash Call and I was treated very poorly. The amount I was willing to settle for $1800.00 on my balance of $2600.00 equals nearly $5800.00 paid on a $2500.00 loan. I have a perfect payment history with them until this last month.

If an advocate or media wishes to speak with me I will cooperate and my desire is to settle this issue with no further payment as Cash Call refused my settlement offer.

Thank you. If you are a loan holder and you have experienced this then please SPEAK UP! Do not let their aggressive behavior silence you.

What's a threat?

Ok, you sign the contract, thereby agreeing to the terms. Later, you decide you've paid enough and make an offer that is less than the agreed amount. They say no and you tell them if they don't agree to your lesser offer you're gonna report them to "agencies." That is considered a threat in NY State. And as a small business owner, I would consider it a threat as well - at the least it's an attempt at coersion, if not a type of extortion. "predatory lending" is a phrase coined by politicians and lawyers. How are you or anyone else hunted down and forced to sign a loan contract? If I entered an agreement to pay you $200 in 4 monthly payments of $50 for the lawnmover I bought from you and then after 2 payments, offered to settle with you for one more payment of $50 and you say "no, I want all my money" and then I tell you if you don't agree, I'm gonna call the police or "other agencies" you wouldn't consider that a threat? Sure you would. Well, that's exactly what you're doing. You DID threaten them and they called you on it.

The interest rate that these fools charge is terrible.....and yes we need to have laws that help protect people. But the facts in this case is that it is legal for them to operate as they have. You knew what the interest rate was before you signed the paperwork, and in knowing this you still signed the paperwork and took the loan. Any sensible person should read any agreement before signing - which you apparently did. So after agreeing to their terms, why do you think it is ok for you to change them now? You cannot change rules just to make you happy.
