Tell us has your experience with this business or person been good? What's this?
I joined this gym in Jan 2003...My 17 yr old daughter showed interest,However;her friends were told you had to be 18 to join...in which is stated in the contract...The sales girl was misleading~~she added my daughter to my account which was a "BIG" misunderstanding...we had words..our understanding was my daughter would talk to her(salesgirl)and let her know if she was interested......As i said;she added her to my contract as of "verbal contract"Soon after they debited my bank account for not only my membership .....in which i agreed upon...and the $42.00 for my daughter. However;when i contacted Jai,the manager he believed his conniving sales girl and denied my credit..which makes me another ripped off, pissed off...customer.I am in the process of a lawsuit..not only did he steal money from my account..he is ripping other people off as well charging them for private training ..that is never delivered.....I cannot go back to this gym because i have been screwed....if i dont get my money back in 30 days i will begin to be the customer he will always regret..he thinks i will never sue...i am not intimidated by his actions,as i come from a family of attorneys and i will have no problem with retaining anyone.......

#2UPDATE EX-employee responds

Fri, October 07, 2005

I truly find it funny that Jennifer has filed a complaint in regards to this situation. I realize it is now almost 2006 but I couldn't pass up a chance to rebut her statements. I would first like to point out that the health club is an all women's facility and me (a man) training anyone "under the table or private training" did not and could not have ever taken place. As a matter of fact, I never once trained one member there in four years. This is the first of many false statements from Jennifer. Jennifer stated very clearly that she wanted to add her daughter to her membership. She discussed this addition to her membership with a fitness consultant and then signed for her daughter. We then started to charge her account the additional fees. Her daughter then decides a few short months later that she no longer wants to workout. Several months (at least 12) went by before we heard anything from Jennifer. During this time her account was being charged according to the two contracts that Jennifer signed. Most financially educated people would have realized the amount of funds being deducted from their account, however, in Jennifer's defense I believe she told me it was her husband and soon to be ex-husbands account. What I offered to resolve this issue: her first option for a refund was denied due to Jennifer being under a signed and legally binding contract. Since a refund was not an option I offered to give not only her but her daughter free time to use the club based on what they had paid and not used. She denied this request to resolve the issue. I then offered a gift certificate based once again on the financial number she (oopps her ex husband) had paid. After realizing this woman was asking for a refund for something that "she" didnt even pay for, I asked for her husbands phone number so I could speak with him since it was his not her money. She would not give me this information and once again reached her peak with her vocal cords and wonderful vocabulary. Like any gentlemen dealing with a less than lady like individual I kept my cool. I offered a few more situations to resolve the issue before I finally asked her what she would like for me to do. She then requested a refund be paid to her for the time that her and her daughter didn't use the club and had paid for. After several phone conversations and several proposals to resolve this issue. Jennifer decided to take other action to obtain a refund that wasnt even owed to her. I did cancel her and her daughters membership without any cancellation fees and a couple months before her contract was finished. Any resonable person would have realized that they had signed a contract stating with their signature that they will meet their contractual obligations. I have closure on this issue with Jennifer and in no way profited from her situation. I have been in this industry for over 7 years and have an excellent reputation as a honest and true person. So you can imagine my shock when I saw my name on this web-site. Although, I was not in the original conversation when Jennifer signed the contracts. I truly believe the employee explained the contract for Jennifer's daughter and in no way mis-lead Jennifer. Kinda obvious since the same employee signed Jennifer to a membership over a year before the above mentioned circumstances took place and Jennifer never once had any issues. I am no longer with Cory Everson's and have no reason to post a rebuttal other than setting the record straight and clearing up my name.
