If anybody could respond with more information I would whole-heartedly appreciate it:

My spouse works for a large commercial bank. She had two credit cards with this same bank (her employer), and her balances gradually increased, and now we're unable to pay them. To cut the story short, the two credit cards charged off a month ago.

Now, Creditor's Interchange is calling her at her branch, harassing and demanding that she pays the cards. Today, she got a call from one of the collectors, and they have told her she risks losing her employment.

Can anybody confirm the validity of this person's threat?

Saffy, First of all, in collections there is no such thing as a "cease & desist". The EXACT verbage from the FDCPA is a CEASE COMMUNICATIONS request. In this request, ONLY make your request for them to stop contacting you which includes home and work, and via third parties. Specify the numbers they are calling, and also tell them you are not allowed to get any calls at work. In this letter, DO NOT provide ANY personal information like DOB, SS#, Banking info, etc. And, MOST important, DO NOT sign the letter, just print. Now, with your letter completed, you need to send it by certified mail, return reciept requested, and be sure to put the certified# on the letter itself, and make a copy for your records before mailing. This procedure is VERY important. Now, when they violate your LEGAL request, you sue them. The FDCPA allows for up to $1000 punitive plus costs, and also actual damages on the civil side, plus costs. Also file complaints on each call to ftc.gov., and to budhibbs.com. It is illegal for them to threaten you in any way, and you can bring criminal charges as well. Good luck.

Please be careful with these people. They blatantly lie, cheat and will do anything to get your money. You can contact their supposed "compliance manager" who, according to his correspondence is really just a Collection Consultant...Chris Fuoco. His number is 877-770-6324, ext. 5373. Better is to send them a "cease and desist" letter and request a debt validation. You must do this in writing within 30 days of receiving written correspondence from them. There are samples of both of these on several websites. Better yet, do what I did. I reported them to the Attorney General of New York. Go to the Attorney General website or to Bud Hibb's website and look at the documentation spanking them legally for doing just what they are doing. They are in violation of the FDCPA and until people start reporting them to the Attorney General, they will continue to get away with it. I know, I had horrible communications with them which ended up costing me $30,000 because I did not know I had any rights at all. Don't let them get away with it. Read the FDCPA carerfully, make sure you document which parts they violated and try to record their phone calls. Also, each violation costs them $1,000 if it can be proved. You can sue them. Report them to the FTC, they have an online complaint form also. Good luck. Download the complaint from the Atty Gen office and send it in with all your documentation.
