Crown Point Resort Did not follow through on cotract - costing me maintenance fees at 3 properties when s/b 1 Horseshoe Bend,, Arkansas
After trading 2 time shares for 1 at Crown Point, they did not transfer or attempt to transfer the
properties as the contract specified. Had they done so we would have been
notified by the transfer company and completed the transaction. Since they did
not do so, I have maintenance fees of $849.00 for this year (April 15, 2013 to
April 15, 2014)as well as club dues of $59.00. I paid those maintenance fees on
4\13\2013 and should not have been liable for them since they would have been
the responsibility of the recipient of those properties via the transfer.
The Timeshare
transfer company(Timeshare Relief Consultants called me when the received the
fax. The deal was done in September 13 of 2012 and they received the fax for
property transfer in March of 2013. The Warranty Deed also has a March 13, 2013
date on it. This only happened as a result of me calling trying to find out why
I was still getting maintenance fees from Bluegreen. I called RCI, and found
that our RCI timeshare is still being channeled through Bluegreen and that is
incorrect as well.
When we saw there
was an issue and began contacting Crown Point about it, they would not return
my calls, particularly Ed Worthington. The first time I spoke to him about it
he said I should call Timeshare Relief Consultants, and my reply was why
should I call them, I have never dealt with them. When I did call the Timeshare
Relief Consultants, the lady asked me why I was calling, and she said Ed should
call and get it taken care of. I again tried to call Ed(4 times or more) and he
would never return my calls. After I notified Ann that I was contacting the
Arkansas Attorney Generals office, Ed did call me. This is about the same time
that he did the contract and faxed it to Timeshare Relief Consultants and sent
me a copy of the Waranty Deed as well. I tried to call him back when I received
the contract and he never got back with me. Ann at the Crown Point Office said
she would have the Developer call me. I called her to follow up at least twice
and as of today I have still not heard from the developer who was supposed to
call me over a month ago. I have since decided that I have wasted enough time
trying to deal with this company.
My wife and I are
hard pressed to tell you what was actually done correctly in this transaction.
We also feel bullied as Crown Point expects us to honor our end of the contract
while ignoring their responsibilities, as well as totally ignoring our
protests. I guess they think we will just shut up and go away.
On top of this we paid $375.00 of maintenance fees for Crown
Point, a property that we evidently had no access too, so shouldnt this money also
be refunded as well? Crown Point made a mistake, perhaps multiple mistakes.
When I called them to notify them they avoided me like the plague and the only
thing they did was try to cover their rear.
They made and already bad situation worse.
I will send copies as I have no way to scan the documents
here at home but I will send them to you in the next week.
Originally we stated that we would be happy if they paid the
Maintenance fees for 2013 but in retrospect we have no comfort that we will be
adequately serviced or honestly dealt with by this company. In our brief
relationship as new customers we have found them to be inept, indifferent, or
dishonest and perhaps all three.
At this time we are of the mind to seek council of an
Attorney based in Arkansas on how to get our money back and negate the entire
deal as it has been bungled severely, and there has been no reasonable attempt
to make good on our behalf.
If you can recommend a pool of such Attorneys that we could
choose from, please advise.
