Excavation per contract was to include haul away up to 5 miles.  Rock Excavation was not an included component of the contract and costs would be left to purchaser/homeowner at a rate negotiated $2400 a day between excavator.  Homeowner stated excavator cost should not exceed $2400.00 for the total.  CrystalClear pools owner Steve Hood License 61718 was not the Excavator under Rock Excavation clause. No named excavation company was provided to homeowner for selection prior to excavation. Steve Hood brought to the property to perform excavator services. During excavation an excavation team identified bedrock. Steve  Hood was unavailable during excavation because he had 2 sick children and could not return phone calls while he was at a birthday party because he phone battery died (text messages available).  

The team was later identified as Troy"Ted"Dixon 46885 DELINQUENT Jan 31 2013 Incentive Resource, Inc located in Memphis TN.  Following bedrock excavation identification,Steve Hood notified homeowner via text messaging. Homeowner was given theoption of continuing at a rate Per Steve Hood of $2400.00 per day with the rate being hourly after the first daily rate per Ted's fee for excavation.  During this conversation, no rate amount per hour was negotiated between Incentive Resource, Inc. and  (homeowner). Steve provided notification that he would pay the $2400.00 for bedrock excavation that should not be more than a day. These funds would be captured from homeowner following completion of excavation. Steve Hood instead requested (end of excavation) of $8888.00 and a check to Incentive Resource, Inc. for $9600.00. As removal of excavated earth is part of excavation, requesting funds for incomplete excavation work was premature. Excavated bedrock and dirt remain on property and pictures have been reported to Franklin City Codes. Driveway to homeowner property has been severely damaged with cracks and shifting secondary to heavy excavation equipment. No gravel was provided on grass - grass is ruined exposing cable and phone wires.  We are disappointed in the lack of excavation completion as provided in contract by Steve Hood CrystalClear Pools.  After informing Steve of homeowners concerns no barrier for excavation hole, rock hail away he responded I would have to think about these concerns and call you on Monday.  We did not receive a call.  After my phone call to State of Tennessee Commerce and Insurance State of TN rep states to verify ALL pool builders and or contractors they refer for bond and license via phone and email.

The State of TN employee stated you should have looked up Troy Dixon license even if Steve Hood brought him to your property acting and representing his company Incentive Resources Inc.  Excavation Services signage located on Ted (Troy E Dixon) were taken by homeowner to identify people working on property.

During initial contract signed Steve Hood did not call 3 months after receiving initial deposit in September 2012.  I have pictures and video surveillance that shows all damage of the property performed by Troy Ted Dixon.  Steve Hood and Troy Ted Dixon did not complete excavation services.  A check was written to Ted E Dixon Incentive Resources Inc.  for incomplete excavation services.
