depending on how the charge was made. If this was a checkcard item, then Bank of America can charge this item back to the merchant. When you give a checkcard with a Visa logo, the merchant that accepts that card has to follow certain rules. One of those rules is that they cannot charge you for additional charges that you haven't explicitly authorized. So, if you stay at a hotel and break a lamp, they can charge you for the stay in the room, but can't charge you for the lamp unless it is actually itemized on the bill. They can't check you out and then charge you a few days later. In this case, you should call Bank of America back and ask them to reconsider your claim. Ask them to note on your claim that you are requesting a chargeback based on compliance with Visa Regulations, since the merchant failed to disclose that there would be a cancellation fee. If necessary, ask for a supervisor. This is per pages 81 & 82 of the Rules for Visa Merchants Card Acceptance and Chargeback management guidelines. Good luck.
