Dan Banagas of Menifee California and American Home Realty and Mortgage lied to us when we rented his home in december of 2007. We asked him specifically if the home was going into foreclosure and he said no.

We gave him 1st and last months rent of 4600.00 on 12/5/07 and our move in date was to be 12/29/07, the house went into foreclosure on 12/20/07 when the bank recorded the Notice Of Default. We found out in January and told him that he had our last months rent and that we would be out in March.

He then proceded to try and evict us from the home even though he would not be the legal owner as of 4/14/08 when the house goes to public auction. He took advantage of us by lying to us just so he could pocket some cash from us before he lost his house and inconveinence us greatly by having to move again in only 3 months time.

he was a little more than pissed when i figured out what he was doing and beat him at his own game. We had our day in court and we won because he filed his 3 day notice to pay rent or quit incorrectly so the judge threw it out :)

Stay away from this guy in any and everything you do, he is unethical and will take advantage of you too just as long as he makes an easy buck that you worked hard for!!

Dan Banagas has now lost all 3 of his homes unfortunately, I guess Kharma did end up getting you afterall. let me know how the rental process is going for you, if you need a place to stay I have a trashcan you can rent, and dont worry its owned free and clear :)

Dan pulled my credit so he knew i was in no shape to purchase a house any time soon, certainly not 6 months but yes i did say that my Fiances parents would be in a position to help us get a home, but it would not be for a year or longer until i could repair my credit but that they would lend us the down payment. I asked him point blank if he was in foreclosure, he said no and so we moved in and litterally 2 days later we got the notice of default on the property and that the public sale date was 4/10/08 (this house was financed by countrywide which had more foreclosures on their books then any other lender in the nation and it took them a lot longer for their proceedings to take place which means he had to be behind on his payment for at least 6 months prior to us ever speaking). We went to court for the eviction proceedings that Dan brought on us and the Judge threw the case out because Dan had filed something incorrectly, I think the judge threw it out because he knew what was going on and that dan was a piece of ____ I have no knowledge of any lawsuit from my previous place. Dan also tried to get a job where i work and he was not hired for something that my company found in his background check, wonder what that could have been??? Sorry Dan, hows the unemployment line treating you??? But like i have always said, any time you want to talk about this we can, just tell me where you would like to meet.

Justin(e) is a fraudulent liar and has serious mental issues. I asked him and Jarmila Atkins if they would be able to purchase the house in 6 months, after negotiating with the lender for lower price. I told him I had multiple properties and could not carry all of them. I also refused to rent this home to several families who wanted to lease for longer term. I told each family the situation and ended up not renting to them because they could not purchase in 6 months. I was only looking for a specific renter who had a great credit score that could purchase the home in 6 months. So, I after Justin(e) lied to me about being able to purchase with the help of his new girlfriend's parents. He said her parents live in Fallbrook and they have are well off and will help them with the purchase, if they could not. Justine(e) and his ex-wife already have a foreclosure on their credit, so I had to qualify them with his girlfriends credit. Justin(e) is in the loan biz, so he knows exactly what we agreed on, he's just playing the victim and acting like a CHILD. I told him, that come June, we would ask the lender to sell at $525,000. He said that sounded great. Not disclosed to me, he was being evicted and sued for his previous residence. Justine lied about having a dog. I asked him to move in early and he said no, then came banging on my home residence begging to move in early because he forgot he had a wedding and ski trip at the end of the month?? Come on. Who's the victim here? And I have to see his ridiculous lies on the net because he is a "Victimizied Baby"?? ...Come on! The judge told him and Jarmila to get out before he has to kick them out. I am still trying to work a deal out with the lender, but thanks to him wasting my time, I may not be able to sell. JERK!!

Was listening to one of those radio talk shows the other day. Somewhere close to 2 millon homes are going to be foreclosed on this year. A LARGE number of them are owned by investors who rent them out. Many of those investors WILL take the rent money even though the homes ARE going to be foreclosed uopn. One renter called in. They had just moved in the week before. They had given their landlord the first month's, last month's rent AND found out the home was being foreclosed on the following week. They were out of luck. With 2 mil homes being foreclosed on, we're bound to see a heck of a lot more of these posts. Thank bush and his buddies for the situation we're in. Greenspan got out while the gettin' was good.
