My husband and I both worked for this company. I was forced to quit a few months ago but he is still working there.

My husband is blind and got a promotion to a higher pay grade. After two and a half years in that job, a new manager and supervisor were brought to the area. They immediately began harassing him.

After six months of these actions, an attorney advised that we should go to the human resources manager and alert her to this. We decided that in case of any retaliatory actions that I would go in since I made much less and could get another job alot quicker than he could. We had been told that the last person to claim discrimination had been fired immediately upon complaining.

I was told it was none of my business and to go back to work in a nutshell. Nine months later, my husband was demoted because he cannot see and they have now made it a requirement to drive pickers and forklifts. Which had really been a requirement all along and he was accommodated for that.

Now, he must accept a lower paying job that he did not ask for or want and that a five year old can do or lose his job. That is the only way that he can continue to receive job accommodations.

He was told by the h.r. manager that he should be thankful that they did not cut his wages more because his new job was not worth what they were now paying, and he should be grateful that the company continued to allow him to have a job.

There are too many actions that his manager and supervisor have committed against him to give all details, but everyone should know that human resources backed up this behavior and he is not the only one these things have happened to.

I stood up for him and was refused my earned raises, had clock in times changed by my boss to reflect tardies that did not exist, was written up for those tardies, refused appropriate medical treatment for job related injuries, and ultimately forced to quit to prevent being unjustly terminated.

Luckily for him, this company's representatives have been arrogant enough to put all of their treatment of my husband into writing. Unfortunately, the attorney he hired is ripping him off now and taking advantage of him. He is over charging him, charging him for work that I have done to save on the fees, and gives legal advice that he later says he never gave him and that it is wrong. We cannot afford another attorney due to loss of his and my wages, nor can I prove the harassment and retaliation that I was subjected to.

We did file a complaint with the Utah Antidiscrimination and Labor Division, and they open a case with the Equal Employment Opportunity Commission. They told us last month that they are not going to begin an investigation until twelve to eighteen months from now. Most of the employees who are witnesses have since been fired.

I just want the world to know that this particular company, which is owned by Daimler-Chrysler, is a very serious violator of constitutional and civil rights of its employees. The corporate office in Detroit apparently refuses to look into the hundreds of complaints and lawsuits made by employees concerning gender, handicap, age, and just about any other type of discriminatory category you can think of.

I have tried to tell the most important pieces of information here but there is so much more to this and it is not right that it should take so long to get relief from this type of work environment. If these things are against the law, a victim should have the ability to get immediate relief.

My husband is only still employed because he has an attorney. However, as of last week, we found out that management officials were told by the h.r. manager that this case was settled six months ago and they believe that they can now get away with this behavior again. It has now begun again and the threat to his job was even put into writing! I will keep those who may be interested updated.

Thank you for the information and suggestions. I will be following them as soon as I respond to your questions. My position at this company was an assembly tech. I built the Series 50 & 60 engines on an assembly line and at the time I was forced to quit was making $12.67 per hour. My husband was a Core Inspector for the Freightliner Core Receiving department for 2 1/2 years when he got the new bosses. He inspected core to determine good from bad for Freightliner parts distributors and then shipped that core to Freightliner remanufacturing centers to be rebuilt. Two months after they took over, they moved my husband to the Detroit Diesel Core Receiving department for "cross training". After two weeks, they sent him to help a mentally handicapped individual who had fallen behind for part of each day. That job was to count and sort valves and springs for cleaning production. Three weeks later, he was moved to that job full time but his pay remained the same. My husband has an Associates of Applied Science degree in the field of Automotive Technology and has been A.S.E. certified. He was told that they felt that he was a safety concern and that he could not remember various parts or part counts and was incompetent to do any other job. The employee he was working with was run out of the company because of his handicap and that is how my husband was given his job. A few months later was when they "modified" the areas' job requirements knowing that my husband could not meet them. It was their way of trying to get rid of him since he did not get mad and quit like the other man had done and they had no other reason that they could use to get rid of him. He has been with this company for over six years now with no disciplinary actions ever against him. He was injured twice because a forklift driver parked his vehicle in an area where it should not have been - OSHA violation! It was his company issued safety glasses that cut him when he bumped into the forklift. The driver just happened to be the H.R. manager's son. That happened over four years ago and no other problems have occurred since the driver left the company. According to all of his previous supervisors, he was one of the most safety conscious and accurate employees as well as needed no supervision and produced more than goals required on a daily basis. All of these despite being blind! At the time of his demotion when job duties were changed, he was making $18.91 per hour. His demotion moved him down to the top of the next lowest pay grade which pays $16.82 per hour. His job is to sort and count fuel injectors by type. Just prior to this cut, the company had given two cost of living increases to all employees which totaled $1.25 and a month before his wage cut he had been given his yearly raise. Between those two raises in pay the total was $1.81. They then cut his pay a month later by $2.09 because he cannot see. I am sorry to write such long entries but I want everyone to know so much about how wrong and how despicable the management of this company is to its employees. There is so much more that I could tell everyone and it is a very widespread problem for all of the employees. Unfortunately, most will not stand up to them for fear of losing their jobs. So far as I am aware, my husband is the only person still employed that has stood up for themselves. I hope this additional information helps and if anyone needs more, I can provide it. I would love to get this publicized and get more legal help from someone respectable and competent that knows the laws for real. Thanks again for any help and info that I can use to get something done sooner than the government agencies are willing to do.

You are going in the Right direction...EEOC and believe it or not the NAACP will take your complaints. Also, i bet there are other improprieties go to Internal Revenue.gov and download form3949A, when they find things wrong with the company, you will recieve 10%. Keep posting updates on these scoundrels. With all Americans suffering there is no plausible reason except to put the American regardless of race/gender or disability out of work and ship them overseas for cheap labor and put us in our places. I was just wondering if you could provide us readers the types of positions you both worked, the job duties you performed, and wages your were earning as to better have an understanding of this matter. If you feel that you were not provideed quality services by your lawyer for the amount you paid or have concerns that need to be addressed. You can ask the "Utah State Bar Association" to look into it. You can also rate your lawer at "Lawyeratingz". I also cant figure out why the anti discrimination devision would take 18 months to begin an investigation unless they are being bribed.
