I am appalled that Diane Van Ness will be a speaker at the upcoming 2009 FLAFCC convention in Tampa.

Such greats at Neena Malik, Honorable Kreeger, Miguel Firpi, and the like will be presenting there, alongside of Diane. They must not be aware of the vile sagas of this white collar criminal, who commits her extortion tactics in the very field about which she will now speak in front of professionals.

I would like to make it abundantly clear about the cases with which I am intimately familiar. In one case, Diane Van Ness took children from their loving mother instantly, with no trial, no evidentiary hearing, no 14th Amendment rights whatsoever. These children had been scarred by the domestic violence they had witnessed the father perpetrate upon the mother repeatedly over many years. When the mother left him and took her beautiful children with her, they were already suffering from the third-party witnessing of the battering, along with the post-traumatic stress and severe parental alienation that came with this horrific package. When the older child, naturally, melted down (at the mother's home, of course; she had fled the abuser), Diane Van Ness snatched them up WITH VIRTUALLY NO CONTACT WITH THE CHILDREN'S PSYCHOLOGIST, WITNESSES, EDUCATORS, HOSPITAL RECORDS, or any contact with the mother's extensive decade long witnesses, either. She reported to the judge that the child(ren) must be acting like this because the mother must be abusing them. This is the ignorance of Diane Van Ness. IF CHILDREN TRAUMATIZED BY THE FATHER'S CHRONIC DOMESTIC VIOLENCE AGAINST THE MOTHER MELT DOWN AT THE MOTHER'S HOME, THE MOTHER MUST BE ABUSING THEM. SHE IS DANGEROUS AND ON THE VERGE OF MURDERING THEM.

As other writers on this site have stated, the extortion began. In a case that was clearly to be pro bono, for which there were no funds, Diane extorted the mother's entire salary, AND WOULD NOT LET THE MOTHER AND CHILDREN SEE EACH OTHER, AT TIMES FOR MONTHS AT A TIME, UNTIL SHE WAS PAID THESE IMPOSSIBLE SUMS. For years, Diane continued to report to the Court (as non-evidentiary status conferences only) that the mother has stopped paying her, stopped paying all child support, written only NSF checks. In reality, the mother had paid her religiously and extensively, beyond reason.

The witnesses, including Miami's top professionals in family law and psychology, called this case "one of the sickest" they had ever seen in their careers, in their opinion.

In another case, Diane Van Ness triple-charged her fees, to the mother, to the father, and to the attorney, and if the mother dared speak up about it, Diane filed a caseload of new, falsified reports about the mother and alleged abuse. When the mother went pro se and filed before the judge what Diane had done, replete with documentation, Diane immediately signed off the case.

Now, let's switch gears for a moment. We have extraordinary experts speaking at the upcoming FLAFCC. Dr. Neena Malik, ironically, writes the floowing on her webpage about her extraordinary work in cases JUST THOSE HIGHLIGHTED ABOVE. Here's what her UM webpage states:

"Currently in development is a prevention-oriented, dyadic therapy program for parents with young children. Focusing on at-risk populations, this intervention research program includes comprehensive evaluations of social and emotional development in young children and family-level functioning, with both cross-sectional and longitudinal components planned. This program offers training in models of dyadic therapy with parents and very young children, including infants and toddlers, and prevention-oriented research. The focus of this program is on children and families at risk for violence and families who have experienced trauma. Theoretical models to be tested include a focus on coercive interactions between parents and their infants and toddlers and the transactional influences of community level factors, such as neighborhood violence, family conflict and violence, parent-child interaction, and child factors on child development and treatment outcome."

Here is an expert model of didactic therapy, intervention, and other needed services.

Diane on the other hand, cries "Abuse" by the very mother who was protecting the children, and allows little to no contact for five years.

It is tragic and reprehensible that this abhorrant woman, Diane, who does not even have a law practice, will be standing next to Miami's top minds in family matters, as if she is a professional.

Let me reiterate, Diane Van Ness does NOT have a law practice. No office. No family law clients. No website. Only a PO Box Number. She only takes on 3 or 4 Guardian Ad Litem cases per year, which she handles out of her home. This woman is a fraud.

This woman is a criminal and I have all the documentation to prove it. I ask that she be called upon to step down from the FLAFCC Conference 2009 immediately.

I must inform you of the extortion techniques of this guardian ad litem. "Pay me or you don't see your children!" is Diane Van Ness' classic modus operandi. My colleagues, clients, and I have all tried to report her, but to no avail. She comes across as powerful, professional, and highly connected. She denies any such extortion techniques and uses court docs, largely created by herself, to deny these claims. Not believable? It's all in writing. And with the top witnesses in Miami. A multitude of cases have dragged on at the cost of families because of her extortion and false docs. Please be very careful before you work with her as a GAL, attorney, instructor, presenter or spokesperson. Do your research. It is recommended that you research sources other than her connected friends. You must be well-informed before you connect with Diane in any way. Thank you.

With everything we have known and experienced from Ms. Van Ness, including GAL violations and extortion tactics, how can we possibly take her seriously... and worse, at a time when we need the FLAFCC, how can we possibly consider her a professional speaker? Of all people! It is public knowledge that she resorts to Extortion, and she has done so in several of my own cases, let alone the multitudes of cases I have witnessed in conjunction with my own. I find this laughable and tragic, that she will put on a suit and pledge to be a pro, when all the while it is pubic knowledge that she is a white collar criminal. I would be willing to provide documentation of the same, if need be. I cannot possibly attend this conference. As long as Diane Van Ness is a speaker, I can guarantee that I and many others will count ourselves out. We prefer to be professional and dignified.

We agree. It is hard to believe that Diane Van Ness, after everything that she has knowingly done to families, will speak at this conference regarding the same field in which she abuses her power. In short, Diane withholds parent/child visits for financial reasons. If one doesn't pay her fees in full by the first of the month, she withholds all visits, even for months at a time. She has a complete disregard for the damage she is causing to the families and children, in both the short and long terms. This, by any other name, is called "EXTORTION." She must "believe" that as a guardian she has immunity. What she may not realize is that a guardian's immunity is not absolute. Further, Diane withholds pertinent records from the Court, and files Agreed Orders that were never agreed upon. Her trick is that she files them as non-evidentiary, so you cannot say anything or bring forth witnesses or documents in Court. At whose cost? While she vacations a third of the year up north and doesn't even practice the remainder of the year? And she bills families while she is on same vacation? At the children's cost. At the parents' cost. We have reviewed all reports filed on this site. We are in agreement with them and have further substantiation, and all documentation to that which is stated herein. This woman's "alleged" pro bono award must be rescinded. This woman should not be representing the very best of Miami's professionals at the upcoming FLAFCC Conference, who try so diligenty to represent, heal, and treat the families they are presented with. This woman abuses her power. Diane Van Ness, in our opinion, should not reporesent the very field which she abuses behind closed doors. We call for her resignation from this conference. IWe are happy to provide any documentation as needed herein.
