I bought a van from "the car lot " in wilmington NC.  About 8 months later we totalled the van in an accident where we hydro planed into the median on I-40.  The finance company" key bank" from Chicago offered us a substitution of collateral because we were upside down about $3000 on the loan and had a great payment record.  The "Car Lot" had 3 cars that they would offer.  We could not get another car unless we signed with them because we had to pay this loan off first.  Our alternative we were told was to go without a car and pay off the rest of the van.  So.. with no recourse we signed the substitution of collateral and got a car.  When we drove it it shook badly anytime we got above 50 mph.  It was the best of the 3.  One had a deployed airbag at the steering wheel when I looked at it.  We had to get back and forth to work so we accepted the terms, given no other option.  Shortly we found out the right front tie rod was bad in our "new " car.  The reason for the shaking.  Not only that but the clutch was going out too.  It was not long before this car was undriveable.  We continued to make payments even tho we couldn't drive it but eventually were forced to call them to reposess the car because we couldn't pay for the repairs and make the payments at the same time.  At this point we still owed about $7000 on this car, (van) .  The value on the car was about $5000, the value on the van would have been about $8500.  Key Bank said they would sell the car for it's value and take that amount off of the amount we owed.  They sold the car for what they reported as $700.  We owed the rest.  Later , when I was buying a new car, I found out it was illegal in the state of North Carolina to sell a car at a dealership without a damage disclosure.  Something we didn't get with the Suzuki under our substitution of collateral agreement.  Afew years later, we got a notice from Dominion Law that we had to go to court to fight a Judgement for the amount left on the vehicle.  I obtained an attorney and went to  court.  Camille French didn't show and it was dismissed.  A few days later I got a notice in the mail that she had shown up at about 4 pm that same court day and readmitted the case and since I wasn't there, because it had been dismissed, she got awarded a judgement against me with no input from me or my attorney.  Now I have this growing debt out there that many times I have tried to settle with no concession on the part of Dominion.  The "Car Lot" has been out of business for years so I can't sue them for non disclosure of damage.  I have no recourse except to abide by what I think is an illegal judgement except...  This IS unlawful.  I've been saving money and I'm close to being able to file suit against Dominion for falsification of court records and non disclosure.  I'll keep you posted.
