What is the Trane Company excuse for not having a sealed contactor? To make money on replacement contactors? 'In fact, the Trane Company will NOT warranty a contactor specifically because of ants.' What is the Trane Company excuse for not having a sealed contactor? To make money on replacement contactors? 'In the Trane warranty information, ants in the contactor is considered an Act of God.' This is probably the company 'Fix' for an unsealed contactor. I believe a real act of God is something no one can predict or prevent from happening. The contactor is neither, because the manufacturer could prevent the 'act of God' by sealing the contactor.

'You sound like the type of person who would sue someone because no one warned you that your coffee was hot.' Not relevant. Space filler. We are not talking about coffee. Also, everyone knows coffee is hot before they buy it. Everyone does not know that the air conditioner company contactor will 'burn' them if they buy the system. You misspelled coffee. 'I have known Mr. Dulin for over 20 years and have found him to be an upstanding citizen and community leader.' Not relevant. Space filler. So what? 'When you bought your house did anyone tell you that you would have to mow your grass, sweep the floor, wash the dishes, or clean your gutters? When you run over a nail and get a hole in your new tire, who do you blame that on?' Not relevant. Space filler. 'Some people are just born to look for someone else to blame, you appear to be one of them!!!!!!' Not relevant. Space filler. Speculation. Congratulations 'contractor' you contributed absolutely nothing at all to the problem and used up valuable server space for nothing. Before you post again, find some intelligence somewhere, and ask a friend how to use it.

As I have discussed this situation with others that I come in contact with, I have received these primary reactions: 1. Appreciation. I know of at least three instances where my forewarning about ant/insect infestation has alerted consumers to avoid costly repairs to their units. This has always been my primary concern/purpose in all of these actions that I have taken. 2. Incredulous. Many people have been completely amazed that a company that depends upon word-of-mouth would not take the initiative to forewarn their clients about the possibility of this situation. Most are equally incredulous that, once confronted, the company did not immediately make changes to their policies and procedures and work swiftly to make this right. From a public relations/marketing standpoint, this situation is really a nightmare and not one that was handled well by the companies involved (both Dulin Mechanical & Trane). 3. Indignation: this is coming from HVAC professionals (only). I assume that is because I have hit upon a hot spot and revealed a way that they make money off of unknowing consumers. This really angers me because that obviously shows that their best interests are not with the consumer, but, with themselves. That sort of attitude is what has brought this country into the financial ruin that we are in now. It is widespread knowledge that the mortgage industry is in ruins; apparently, the same attitude has spread to the HVAC industry as well. To the consumer that suggested that I would sue over my coffee being hot, that is ridiculous. I am a certified apartment manager, having managed an apartment complex in the southern US for over 10 years. I am currently a mortgage underwriter for a large bank, so, I am quite familiar with property requirements. Additionally, I grew up helping my father manage properties for my entire life. My father was a licensed electrician (IBEW), now deceased. My uncle was an electrical engineer (now retired) as is my cousin. I have literally grown up aound electrical things that were outdoors. NEVER in my life have I ever heard of even the remote possibilty of ant/insect infiltration. Nor have any of my family members, all of which are very qualified. Not even when my father serviced electrical things in the basements of ghetto tenaments where all sorts of insects were common did he ever mention that the insects had shorted out an electrical object. This is why I am convinced that this is a consumer issue that needs to be addressed. Consumers need to be aware of what they need to do to protect their investments. This is a real issue. Companies that survive will embrace this and carefully advise their clients what need to be done so that they can work together to protect the consumer. When the consumer feels as though they can trust their professional, the business will return and be recommended. IF the consumer does not feel as though they can trust their professionals, well, competition will rein and that company will feel the result of their neglect. The decision is up to the company as to whether they want to cater to their customer or not. My goal here is not to do anything but to alert consumers of a very bad experience that cost me a lot of money and what they can do to avoid that same situation happening to them.

(The consumer indicated he/she DID NOT accept the response from the business.) The terms of my complaint have not been satisfied. The preventative maintenence technicians did not alert me to the possibility of ant infiltration despite the fact that the ants nest was less than 8 inches away from my unit. I have never heard of such a possiblity nor had any of my friends. That is why I want it included in a disclosure with the new installation and preventative maintenence of every unit. Checking for ant/insect infiltration is not even listed on the preventative maintenence checklists provided by Trane online. Hence, how is a homeowner to know that this is a possibility? This complaint is not only for myself, it is for the consumer at large. There are many people that do not know anything about HVAC units nor the upkeep of them, which is why they hire professionals to advise them. If we are not properly advised by the professionals that we hire, how are we to know what to do? Conversely, how does it then become the fault of the consumer when something is not done and the part fails? The company states that "ants are an act of God". I am not disputing that. I am disputing the fact that nobody TOLD me that having ants or insects in my HVAC unit was a possibility until I started yelling that my unit was going out multiple times in a week. Logically, one would think that a new unit such as this one would be properly protectd against such things due to the fact that it is a known fact that it would be outdoors and possibly prone to such things. Also logically, one could understand that a fluke in weather, such as a severe drought, could wreck havouc in the "normal" protection provided. However, in a regular summer, the probability seems remote or non-existant if one were thinking logically (as I was). Other mechanical things that are outdoors, such as cars, do not seem to have these issues. Hence, I was reliant upon the advice of my preventative maintence technician who did not mention one word about checking for insects at any time. My desired resolution stands: refund the preventative maintenence contract money since the unit was not properly maintained to begin with, then, refund the payment for the service and a written disclosure must be given to the consumer with every new install and every preventative maintenence service alerting the consumer to the possibilty of insect infiltration and what to do to prevent them. My next step will be to go to the state legislature to get those disclosures required by law. As I stated, this is not just a complaint to benefit myself, it is for the consumer at large. ---------------- NOTE: The company DID return my check for the service, however, this was not sufficient to satisfy my complaint.

Common sense says if it happend once, it could happen again. There is no scam here. Just a homeowner wanting something for nothing, or wanting to place the blame on someone else. As a A/C technician, many times I have told homeowners about this problem, and their response is I'll take care of it. Well guess what. They don't and then they call and complain again. Have you ever seen an ant inside your home, car, place of business. Anywhere? The A/C company is not trying to scam you..... You are trying to scam the A/C company

The scam is NOT that the ants exist. The scam is that there was no disclosure/warning that the HVAC unit had even the possibility of being infultrated by the insects. Not even when the unit was inspected by the technicians for preventative maintenence AND the ants nest was fully functional only inches away from the unit. THAT IS THE SCAM.

In reviewing this report filed by Margaret Clements, I find no fault in my company for any services that we recently provided for her. Dulin Mechanical installed a Trane unit back in 2005 for Mrs. Clements. This unit has had no mechanical problems at all. Her interruption in operation came from a small part in the electrical panel called a contactor. It is not uncommon for insects to penetrate this contactor or any electrical components and thus cause electrical failure. In fact, the Trane Company will NOT warranty a contactor specifically because of ants. In the Trane warranty information, ants in the contactor is considered an Act of God. Ants were found in the contactor for the first time at Mrs. Clements back in September 2007, my technician cleaned out the contactor, found no pits in the part and got the system back up and running. However, by June 5, 2008, the ants had become so numerous inside the contactor that pits had been formed and ruined the magnetic part inside the contactor. Basically, the contactor could no longer function. When my technician replaced the contactor, he advised Mrs. Clements to call an exterminator to rectify her situation. At this service call on June 5th, my technician did not even charge Mrs. Clements a diagnostic fee of $85. He only charged her for the contactor itself. Unfortunately for Mrs. Clements, one week later on June 11, 2008, ants infiltrated the contactor again, caused damage again, and thus, we had to install another contactor. At this point, we had to charge her for our trip out to her home as well as the contactor because it had become negligence on her part for not taking preventative action by hiring an exterminator. Dulin Mechanical is mid-size local company that has been providing HVAC services to the Charlotte area for a long time. We always work with our customers and do our very best to keep them satisfied. To my knowledge, Mrs. Clements did not even call our office to make a complaint or ask to speak to me and/or my service manager. You can review my company's record with the Better Business Bureau. This complaint by Mrs. Clements is our very FIRST complaint EVER with the BBB. In filing my response with the BBB, it was immediately resolved. Mrs. Clements's Trane unit is not a lemon. We cannot control the ant environment around her HVAC system.
