We have lived in our home for 11 years. We originally started out with PHH Mortgage, who sold our contract to Alaskan Seaboard, who then sold our contract to EMC Mortgage. This happened within the first four years after buying this home in 1994.

We have had our mortgage payments raised periodically for one reason or another, none of which we had any control over ourselves. I lost my job in 1998 (after 23 years of service) and I had a very difficult time keeping up payments as well as a series of medical bills because of my husband's health. I finally found a full time job, which pays well, but still had to file a Chapter 13 due to my husband's insurance going bankrupt and the medical bills and prescriptions were out of sight.

Needless to say, I got behind on my house payments. EMC would not honor the Chapter 13, and sent me a letter stating that if I would pay $600.00 per month for the next year I would be caught up -- but this went on for 3 years. When the bankruptcy was discharged, they did lower my payment to $569.92.

Even though I have had a hard time keeping up with the payments, they have still threatened foreclosure and now because of this, I have to pay an extra $100.00 per month to pay "lawyer fees" for the next year. They have stated they are willing to work with you, but when you call with a problem, you usually have to leave a message and they are supposed to call you back within 24 hours; however, I have left four messages this week and have yet to get a return call.

I am a 69 year old and am trying to keep up with utilities, medical bills, prescriptions, insurance, and this house payment. Even with a full time job and social security, I am lucky if I can afford groceries. All I want is for EMC to honor their commitment to me in returning calls and "working with me" My credit report shows me as being six months behind, when in fact, I am not behind at all!

Agnes- they will never let you catch up. They will add too many fees. I have never heard of anybody escaping EMC without paying their extortionistic fees. I too paid excellerated payments for over 3 years. They also demanded 14,000 in "downpayments" In the end- I ended up owing them many thousands more than I borrowed from them. All the amounts you pay extra each month are NOT going to what they tell you. Refinance- sell the house- Do what you got to do to get away from them.
