EMC Mortgage Corporation has ripped me off.

I am a single mother of three, and I am disabled. EMC knows about my disability,through correspondance. I speak fluent spanish but have problems with the english language.

I've asked EMC to send me information in spanish but they refuse to do so. I have two accounts with EMC, both of which started with Superior bank. On one of my accounts they did not post more than $5,000 dollars, which I have the proofs. On the other account they didn't post more than $30,000 dollars, which I also have proof. They have lied in Bankruptcy Federal Court,dening all this of which I have all the proofs.

They've harrassed me on the phone, by mail, and in person. They have paid my taxes late, and are now charging me for all the late fees,approx. $10,000 dollars. Also the monthly payments I paid were posted late, then I was charged the late fees. They've destroyed my credit and my life! And now are terrorizing me with the foreclosure of my home and leaving me and my children, homeless. I've lost more than $200,000 thousand dollars.

They have also denied me my monthly statements. The title to my properties were sent to me after two years, after my persistence in trying to get them. One of my note started at $71,600 dollars and now it's at $195,000 dollars. My health condition has worsen through all this. Now, I suffer from post traumatic depresss chronic and bipolar depression. Please help me!!!

I fell behind on two payments with emc last year. Yes it happens but I thought I had made them up in December but around that time they escrowed late city and county taxes into my loan. My loan never had taxes escrowed before but since they were late they took it on their own to put them into the loan which raised my paymets by 250 a month. This is legal so pay your taxes. So at this point I am screwed, I call and asked if there was anything that could be done. They said well we can take these taxes and roll them into a 3 year plan making your payment 631.00 a month which was only about 100.00 dollars less. Being strapped for cash I took the offer. This was so called approved for all prior months as well as the regular payments when the escrow went into effect. I was told this and thought everything was taken care of. Well it turns out they started to escrow my taxes way back in November of last year without my knowledge so every payment I made on the loan was not accepted as a payment because of the 250 increase that by their words now was never approved to reduce in the first place, i found that out on my second call. Your head spinning yet mine sure is. Anyway this put me behind 3 payments and im ready for forclosure, as they say. I called many times spoke with people on all ends and they said they would fix everything. Felling satisfied on my last call i called tonight and low and behold Im back where i started. Now I am still 2 months behind no matter what I pay them. I made two payments in one month and have no idea where they went. As far as getting answers out of them they give you all kinds of bull and the run around. I just got off the phone with a Mr Bostomonte from EMC and I thought he was going to go into laughter when I pleaded my case. He had a forcfull attitude you know how those phone jockies are big men behind a phone and cowards in real life. Anyway He said talk to a supervisor next time and prove your payments. Hey look at this point I am afraid to give them anything . All I can say without legal counsel your not going to get anywhere with them and I am not saying with legal counsel you are either. I can't make that case here because I have to talk to a laywer to find out whats going on. Anyway I have come to the conclusion that they are just out to take your home plane and simple. They could care less about any true story you give them and they are ready to foreclose at any moment. I do not see anyway out of this but If you can get re-morgtaged do it. I know a loan sounds simple but if your reading this I know emc has a bad mark on your credit rating by now and your not going to get anything. So you can sit back think your going to work it out but do not do it alone call a lawyer one that will listen to you not one that is telling you go bankrupt. Trust me always leave that option open if it really comes down to them forclosing on you you need it then not now. If you do file chapter 13 too early they will get an agreement for back payments while making your regular paymnets but look into the future what is to stop them from doing the same thing to you down the road? What if they do file for forclosure against you now what do you do? You can't do anything for six years after filing and this was suposed to get you out of trouble. Well look im going to fight these people to keep my home im sick of walking in my house fixing it up and wondering next month if there going to take it from me. I work hard for what I have, it might not be much but I have it and i plan to keep it from them the legal way. Again my advice if this has not happend or anything in this forum has not happened to you yet it will but before it does get out of dealing with emc. If anyone here has advice for me please feel free to post I would appreciate the help.
