EMC Mortgage ripoff they are holding my payments Irving Texas
Ironically, I was searching for EMC's phone number to argue with them over my payment once again, when I found this site. Is there anything we can all do about this company?
My story sound exactly like everyone else's. My loan was sold to EMC and I have had nothing but trouble since. They are telling me I am 2 months past due and I am not. I sent them the current month's payment 2 weeks ago. They claim they do not have it. This happens with every payment. About 4 weeks after I mail my payment, it gets posted to my account. It takes me hours on the phone to convince them they have my check every month, and guess what - they always manage to "find" it. They do this on purpose to make my payments late.
How can they get away with this and is there anything I can do about it. I can't get refinanced because - guess what - EMC shows my loan 2 months past due. If anyone can help, please let me know!

You know I'm really beside myself here. I have EMC and have posted a few times here about them. They have done almost everything to me as well. This should not come down to sending certified checks and a return receipts to them! to All just to make sure they sign for the payments. Who do they think they are? I'm not even going to go into the many circles you get on the telephone with the collections department. This is just a predatory company and has to be stopped. They will find anyway to bleed you dry of your earnings and end up taking your home anyway. They lie and deceive everyone.They almost had me thinking I was behind at one point. Don't even try to call the banking commission there is nothing they can do already did that. The only thing here is to band together there is strength in numbers people we need to take action and turn EMC belly up before they take us all down.

If you send your payments certified/return receipt, they will try to get on something else, like force-placed insurance which they add to your balance but you won't know how much and then end up sending the "incorrect amount" for your payment, which they don't have to accept, and it ends up in the "suspense account". After 2 months they start foreclosure! This is what my servicer tried to do to me! If EMC already has you 2 months behind perpetually and ruined your credit so you can't refinance, you need to get with people that have "been there, done that" to get some answers. Please make a search for Mortgage Servicing Fraud. Your will find a website that has a forum where you can ask questions and find a lot of info. Don't wait! Your servicer doesn't!

to answer you question about what can you do about payments not being posted at the time they recieve them. the only thing you can do to cover yourself and your payments is to send ALL of your payments in the form of a CERTIFIED CHECK, WITH RETRUN RECEIPT ONLY!!!! if you do this then you are creating a PAPER TRAIL you will be able to prove to a judge, whoever, that they received the payment on time, and there is no reason for them to post late!! trust me once you start paying this way they will leave you alone!! I learned the hard way, I am in chaptr 13 protection until I can get a new lender. I have not missed one payment with them and they say I have not made payments since 2002. The only thing I had was all of the returned checks, but I still have to fight them in court for over 13,000.00 dollars in payments that have not been credited to my account. Now ALL of my payments even credit cards are send c.c/r.r. the only way! good luck!
