My case was won in court.  The defendant chose to get an attorney after she lost - to negotiate or to try to somehow get out of the court mandated judgement.  It was too late, the 30 days had passed, so this attorney tried to negotiate a lower settlement, which is common.

However, he repeatedly lied to my attorney about payments being sent, he would always say the check should be sent on this date, then that date.  We sent repeated "this is your last chance to do right by your client notices."  We were very forgiving, knowing that it is a pain to file for discovery of assets.

After several weeks, after NOT receiving a check, we finally decided to file for a discovery of her assets.  This is the problem with the debacle that was created, now the client will be forced to pay not only the original sum, but additional fees for causing us to file for discovery.

If you come across this attorney, know this - it might be a one case accident, but we have been fully communicating with him, and he has been evasive and elusive.  He cost his client - at least an additional 30%, $2,000 by not being forthcoming, by not replying to our communications.  We could have files for this about 6 weeks ago, but his run around has now caused at least 3-4 extra hours of my attorney's time (which his client will pay).  Maybe he was running up her bill, maybe he just sucks.  Not sure.  

This may likely be reflected on the clients credit report, it will be reported to the better business bureau, the states attorney general that his client didn't pay a court mandated order.  Is it his fault?  You be the judge, but I wouldn't hire this attorney to represent me in a million years.
