I am a 24years old, a graduate student studying in philadelphia.
I rented a car from enterprise back in december 2012 with my canadian driver license. On the day of rental, they asked me whether I have a personal car insurance. I told them I don't and I would need a full coverage for my car from enterprise because I will be driving a car to washington D.C. He suggested me to get the damage waiver for 19.99 dollars and also suggestsed me to just purchase the gas from enterprise because then I won't need to worry about filling up the gas after the trip. He also gave me a free upgrade to a compact car.
So after all the taxes and everything, I ended up paying $158 dollars. One fifty-eight dollars for one day rental!!(without gas, it was already hitting $90 dollars). The day when I returned the car, I found out some scratches on the right side of the car. I reported the scratches and the enterprise guy said I will be covered since I bought their full insurance. He asked a few questions bout the scratches and I told him I got them in washington d.c. Now this got me into a trouble...
After two months later, I got a call from enterprise but it was during the day so I could not respond right way. So I called them back after school hours and left several voice messages but guess what they never got back to me.
about 5 months later, I got a call from a collecting agency that I owe enterprise $1900 dollars. I asked them why do I owe them so much money, and guy quoted "the enterprise found damages on rear and front bumpers as well as other minor damages and the balance includes repair fees, administration fees, drop of car value fee, labor fees and etcs.." I told them that I had their full insurance. But the guy quoted "the dw i bought does not cover any damages occured outside of pennsylvania". He said the the damage waiver i've purhcased was waived(I guess he meant refunded back to my acc?). So I checked my bank account for the past 6 months, I couldn't find any refund transaction. I told him that I was never informed about ths policy and also told that I was never informed about the damages other than the scratches
So I was on the phone with collecting agency for a couple hours and things were not getting better. So I simply told tem that I will not pay for the damages that I am not responsible for. After a month later, I got a call from them again and saying that they reduced the balance to $1300 dollars. At that point I felt they are just trying to scam me and trying to deal me out. So I told them again that I will not pay for it still.
I told the collecting agency that I want like to speak directly to the enterprise. That is the situation right now.
So technically, I was driving in washington D.C without insurance eventhough enterprise had my money. Their website states that the rental car needs to be insured either by the personal insurance or by the enterprise. At the time of rental, I did not have any personal car insurnace so I was obligated to purchase theirs. I even told them that I will be driving to washinton D.C. That's why they recommended the full dw + purhcasing their gas!!!!(I payed extra $60 dollars for it on top of my rental ) What kind of absurd is this? If their insurance does not cover outside of pennsylvania state, they shouldn't have sold me their insurance.!!!! Furthermore, I was never informed about any other damages on the car except the scratches at the time of return but now they are hunting my a*s for all the damages that I've never heard. Are they really trying to scam me? I've heard many stories about enterprise but I just can't believe this is acutally happening to me....
I am a poor graduate student who cannot afford to pay the money. I need some serious help right now and I just don't know what to do. My school provides some legal services for students may be I should go seek their help. I'm all stressed out right now because of this complete bs.
