My mortgage was sold to EverHome a year ago and they have misapplied mortgage payments twice now. I became aware of the second misapplication yesterday evening when Everhome called demanding a payment that I made over two weeks ago. After I provided the confirmation number of the payment and date the representative hung up. The last time this happened Everhome reported a late payment on my credit report. Each time I've called to correct the error I've been told that "it is my problem" and "my responsibility." I'm afraid this will be repeated further impacting my credit score. Any suggestions, advice or assistance will be greatly appreciated.

Everhome Mortgage Company does not own my loan; they only service the Fannie Mae that it is. I only found that out by calling them and asking them: Do you own my loan, or do you service it for someone else?" I called them after being advised to find this fact out. They were very nasty to me and took forever to actually answer my question. Finally told me that they serviced the Fannie Mae loan that it is. I had requested their package to file for loan modification. With the new options available on loan modifications, Fannie Mae's in particular, this was hopefully good to find out. They also told me that when I got my package from them that I was to fill out the information, and apply for an option. Then they would look things over and tell me if the option I was asking for could be done. Well, that seems to be a waste of time? Because, if I couldn't do the option that I wanted to do, then that would delay getting anything done. So, again, I needed to know the answer to my question so that I could KNOW what option I could, buy law, apply for. I then faxed all my info to them. It took them 10 days for them to acknowledge the receipt of my documents. It took another 10 days to assign my packet to a person. So, now I wait. I am at the 60+ late right now. I will make a payment before the 90 foreclosure? date. I did receive a letter with that foreclosure warning; funny thing..........it uses the word "consider" foreclosure. From whay I am hearing from many people is that Fannie Mae WILL work with you. I pray that this is true; I love our home and want to keep it.

My fears about EverHome mortgage were confirmed. Rather than try to process the payment with the confirmation number, amount, etc. that I gave in the phone call, EverHome mortgage simply reported the payment as late on my credit report and added late fees and bad check fees to my account. (My bank has confirmed and documented that EverHome never attempted to process the payment.) I discovered this when I logged in to make the following month's mortgage payment. Despite paying all of the charges, the mishandled payment, and the current month's payment (not considered late for another 7 days) the same day, EverHome has now begun the foreclosure process. I'm told this is not legal if all payments due on account have been made. EverHome Mortgage's website tells me I owe nothing for another 15 days. How can they proceed if my payments are current? Do I need a lawyer?

Whenever I make a payment to anyone, once I see the amount has been deducted from my bank balance, I either go online or call to make sure the company posted my payment. Don't assume that since they cashed your payment that they posted it correctly. Make sure they did.
