Experian defamation of character as a result of sloppy credit reporting Costa Mesa California
Experian has included items in my credit report that have absolutely nothing to do with CREDIT that are substantially lowering my CREDIT score and resulting in higher interest charges than I should be paying on car loans, leases, credit cards and my home mortgage. Repeated attempts to get these items removed have failed. It is impossible to speak with anyone in person at Experian.
One item in my credit report is a small claims judgement against me due to a bogus injury claim as a result of an auto accident that my son had (with a car registered in my name). The result of this? My record now shows that I have a "derogatory public record" and apparently this takes a big hit on my credit score, although Experian won't reveal the secret formula they use for credit scoring. The $2000 claim was paid by my insurance company as soon as the small claims court ruled, so there is nothing owing, but Experian's reporting of this implies that it has something to do with credit, such as a collection on a credit card. Experian's policy is to report all court judgments against an individual as very serious negative on a credit report. Does this make any sense?
The second item that appears is a parking ticket that was supposedly paid "late" to the City of San Diego. Again, no credit agreement was ever entered into between me and the City of San Diego. Still, Experian reports this as a "serious delinquincy" on my credit report. I have asked the City of San Diego and Experian to provide proof that a credit agreement existed, but neither claims they need this to report as they are.
If I do not get this matter resolved, I will be taking first Experian (followed by other credit reporting agencies) to small claims court with a $5000 claim for defamation of character and extra interest charges I will be paying for the next 7 years that these items remain on my report.
Others reading this- please take Experian and other reporting agencies to small claims court to discourage them from using their ridiculous reporting practices. Other agencies to bring suit against include Fair-Isaac- the company that invented the secret magic credit scoring formula that Experian and several other agencies use to determine credit risk.
