I was in the process of purchasing a small business and needed some additional resources. Searched over internet and found these people - EZUNSECURED.COM. Filled out application online and was contacted by Leo Davis.

After I negotiated their success fee from 10% to 5% I thought this is the comapny I will go with, since I had other people calling me too. But EZUnsecured has as they call it, Professional Services Fee, which in my case was $1,500. Leo told me I had to pay that upfront and sign the package and fax it over to them otherwise they will not start working on my file.

He said you are guaranteed to be approved for $200,000 with your credit score that you are stating. And I have my credit report in my hands. In fact I told them it is 806 but report shows 836. And I am sure my credit score is higher than they are requiring. Everything sounded too good to be true, I was hesitant for couple of days, but decided to go forward with this. I asked several times what if I do not like the interest rate or some other terms, like lengths of the loan, etc, will I receive my money back. Leo replied that I can back out any time and receive my money back. Now they are telling me to forget my money.

After several days I received an email that I was rejected and that they can apply for personally guaranteed loan for me. I said I am ok and I specifically stressed out that as long as it is not less than 2 X $100K lines. Next day I receive an email that my package was submitted to bunch of companies: $100K, $35K and bunch of $25Ks. I asked them to stop that ASAP, was not I clear enough in my email. The replay was they only had one institution for $100K. I said O-OK-ey let's go only with one line for $100K. Then I receive an email that I have to call the company and apply for the loan myself.

At this point I started realizing that I am dealing with wrong people. Why am I paying the so called Professional Services fee and why am I even wasting my time with these people. I asked to cancel everything and I want my money back. The reply was I do not qualify for refund. I said but I confirmed it with Leo several times that I can back out any time and receive full refund. The reply was that I signed the Package docs according to which I do not qualify for refund and that Leo had no reason to mislead or misrepresent. But I guess everyone will agree $1,500 is more than good enough reason for them to lie.

This is how these scammers are making money. The question is why are they keeping my $1,500, I did not receive any professional services from them, they are total mess, right hand does not know what the left hand is doing. I cancelled it because they could not deliver what they were promising. On their Agreement they state I a have right to cancel without penalty, then what is the $1,500 that they are not returning, isn't it a penalty? I decided not to use their services, why can't I receive my money back. This is vey HARD EARNED money and I can not afford to loose it.

LUCKY ME I HAVE RECORDED MY CONVERSATION WITH LEO, thank to today's advanced phone technology. They asked for the recordings, but guess what I am going to send these recordings directly to the Financial Department of Nevada. These type of businesses have to be shut down and scammers like these have to be punished and they have to answer to the justice.

Bottom line is stay away from this company and do not be the next victim: EZUNSECURED.com - JADE ROCK ENTERPRISES - LEO DAVIS - PAMELA DIAZ - KARLA THOMPSON - Monique Johnson. All these people are involved in this scam.

By the way I checked online and I'm not the only victim of theirs, I found at least two other people are their victims too. I hope that State of Nevada officials will finally knock at their door and EZUnsecured will have some explaining to do.

Next thing I will be doing is filing my claim with the State of Nevada Financial Department and hope they will at least loose their license to do business if not more.

Client demanded a Refund because he wanted to buy a Sandwich Shop and he now no longer wanted to buy it, and he wanted one single loan for $200K and claims Leo Davis told him he would get a Refund if he did not like the terms of the loan, for which he has no proof and Leo denies. He even admitted not reading the Contract before signing it and it he refuses to let us continue working on the File even after I offered to discount his success fee by 50% to 2.5%. He basically changed his mind about buying the Sandwich Shop and made up a story to try to get his money back. We prepared 6 bank applications for this client- completed a full review of his file, pulled his personal credit report and at the time we were going to submit him he informed us that he will only accept lines in the amount of 100K or more- then he decides he only wants one loan for 200K- He was impossible to work with and in today's market it is nearly impossible to get someone without a valid business a loan like this- I tried explaining this to him but again I will say he was impossible- We offered him a refund and then he informed us he had already posted on ripoffreport.com and other sites as well, our contract states we will issue a refund provided the client meets a minimum criteria and does not breech written agreements with us- Garik breeched his agreement with us so therefore he was not issued a refund. This contract is unlike any that I have seen in lending. Marcio Andrade, the "owner", also has this type of chaos within his company. One week 10 people at the company. The next week 10 different people at the company. And this only 1 month. Stay away. I have seen maybe 5 loans close, at best. Out of 60 applications, whom will qualify for their loan. The contract is legal but it should be, lawyers wrote it, right? That is not the point. The point is service and paying for a percieved service. Some fault must be placed on the American consumer, in general, lazy. Good credit/bad credit/in the middle credit, lazy. If they don't understand something, they will gladly pay up. If they don't get service, most would walk away. Chalk up as a small loss. Marcio Andrade is just playing the law of averages. EzUnsecured.com hedges it's bets on basically, people not understanding what they are signing. But even with an MBA, if you don't understand contract law. You might have some difficulty getting your money back. Because you will have file a lawsuit to get your money back. It will cost $1,500 for a lawyer? Well, I just paid EzUnsecured.com $1,500. Do I really want to pay another $1,500 to a different crook, a liar. I mean lawyer. All of this is just more of the same. Crooks with a different title. If you are busy putting out fires all day, how much time do you have getting results for your clients? Results being, closed loans. Always an excuse why the loan is not closed. If your business is failing and you need to pay employees whom have signed agreements, as well. Where would the owner get that money. Could it be from all of those credit cards with the applications of the trusting clients? Good at taking the money not good giving it back. Or, refunding it to people who basically could walk into a bank anyway. Get off your butts America. Walk to your local bank. This place is the worst.

I asked Garik to provide me with a copy of this recording that he has. He replied that he is not sending me anything! I didn't say he had to send me his original, just a copy so that I could hear it for myself and immediately address any problems. He flat out refused to cooperate. This clearly is a shady practice in my book. Most know that the average person can't possibly read (or understand) the fine legal print. They're literally "banking" on it. Beware of anyone requesting money up front. Why would they work hard for you once they've already been paid? I thought the OP's emails were pretty clear. In the age of the internet, why on earth would you need a consultant to begin with???? Do the research yourself in the future!!!! Good Luck.

F Germain, looks like you are very well aware of their documents. Their contract states I have the right to cancell this agreemnt any time without penalty. SO I'm cancelling my agreemnt with them, I decided not to use their so called professional services. SO why are they keeping my "Professional Services Deposit" if I'm not using their services? We are not talking about their Success Fees here. I'm an insurance professional myself, if I describe to you one thing and sell you something else with you signature on it I will get into big trouble for that. And that's what Leo did, you can't misrepresent promise everything knowing you can't get even close to what this person wants. Why did he mislead the facts that are on their company documents? He has know right to be licesed in this field, he broke the below Nevada Financial Dept code and he has to answer for that to the state: NRS 604A.440 Prohibited acts by licensee: Improper lending and collection practices; deceptive trade practices; false, misleading and deceptive advertising; using agent, affiliate or subsidiary to avoid requirements or prohibitions of chapter. A licensee shall not: 1. Use or threaten to use the criminal process in this State or any other state, or any civil process not available to creditors generally, to collect on a loan made to a customer. 2. Commence a civil action or any process of alternative dispute resolution or repossess a vehicle before the customer defaults under the original term of a loan agreement or before the customer defaults under any repayment plan, extension or grace period negotiated and agreed to by the licensee and customer, unless otherwise authorized pursuant to this chapter. 3. Take any confession of judgment or any power of attorney running to himself or to any third person to confess judgment or to appear for the customer in a judicial proceeding. 4. Include in any written agreement: (a) A promise by the customer to hold the licensee harmless; (b) A confession of judgment by the customer; (c) An assignment or order for the payment of wages or other compensation due the customer; or (d) A waiver of any claim or defense arising out of the loan agreement or a waiver of any provision of this chapter. The provisions of this paragraph do not apply to the extent preempted by federal law. 5. Engage in any deceptive trade practice, as defined in chapter 598 of NRS, including, without limitation, making a false representation. 6. Advertise or permit to be advertised in any manner any false, misleading or deceptive statement or representation with regard to the rates, terms or conditions for loans. 7. Use or attempt to use any agent, affiliate or subsidiary to avoid the requirements or prohibitions of this chapter. (Added to NRS by 2005, 1691)

First of all I told Leo several times that I'm in the process of buying a business I never stated that I have a business. Second from the very begining everyone there in your SCAM company knew they could not get me approved for $200K, I do not need your $10K & $20K lines, I was very clear in my emails, why did you charge me and went forward with my case. Third, thank you for posting my emails I think they are more benefiting me, so evreyone can see that I was asking something else and getting totally different thing from you, your company is total mess that's why I did not want to deal with you anymore. You are only good at ripping off people not providing services that yiu are licensed for. Fourth, I am going to file the same claim with State of Nevada over this week-end, be prepared to answer to authorities. And fifth I have a credit report that was provided to me by Bank of America raight about same time and it shows 834. PEOPLE TAKE MY ADVICE AND STAY AWAY FROM THESES SCAMMERS.

I do not think you are reading the rebuttals correctly and if you took the time to research the company the way I have their contract states the following: WE CANNOT GUARANTEE THAT YOU WILL BE APPROVED FOR ANY SPECIFIC AMOUNT, AND THE SUCCESS FEE WILL STILL BE DUE IN CASE THE APPROVED AMOUNT IS LOWER THAN THE AMOUNT REQUESTED. NO DOC LOANS AND LINES OF CREDIT WILL USUALLY COME AS PERSONAL INSTALLMENT LOANS IN INCREMENTS OF $10,000 TO $100,000 PER LENDER, AND SEVERAL CREDIT APPLICATIONS MAY BE SUBMITTED IN ORDER TO ACHIEVE YOUR TOTAL REQUESTED FINANCING AMOUNT. As far as I can tell by the emails in the rebuttal from the company, they tried to tell him all of this and he was just being unreasonable. Are you people evening reading what your rebuttals are? The client clearly asked for $200,000 or at least $100,000. You knew you could not deliver but you still continued with the loan anyways to charge him the review fee. When the client requests for his money back, you say he is rude. Read the emails he sent you, they are not rude. He specifically states he needs a certain amount. Why do you take on the deal if you cannot deliver? You know as well as I do that there is no way you can give him $200,000 for a start up company in this lending environment. A fico score of 750 is great and that score more than qualifies him. If you are telling me that this client needs to fix his credit, you are full of it. With 750 fico scores, any lender would accept that score. Just admit it, your company is a scam and you are out to charge people "review fees" and giving clients lines that they do not want so you can charge your 12%. You justify it by saying you put all this work in. What work? To take an application and to run the credit. You do not do anything for the client to justify charging $600. Big deal the client can go to any bank and do the same thing for free. Then you charge 12% for lines that clients do not even want. To be honest with you that is borderline identity theft because the client never authorizes the line and you accepted the lines on their behalf. Shame on all of you! THE BOTTOM LINE IS YOUR COMPANY IS TRULY A RIP OFF FROM WHAT I HAVE READ.

Again, I wonder if none of these folks read what they were signing. This person clearly did not read the portion of the " consulting agreement" they had him sign where it said and I quote: 110% FUNDING GUARANTEE : I agree and understand that if JRE is NOT successful in obtaining financing I will receive a FULL REFUND of the Professional Services Deposit (PSD) I have made plus 10% of such PSD as liquidated damages provided I meet the Refund Eligibility Criteria outlined in the Client Disclosures . Furthermore, even if I do not meet the Refund Eligibility Criteria JRE shall continue to assist me in obtaining financing for a period of up to 90 days. TERM: I understand that this Agreement will be in effect until the last credit application submitted has been concluded (approved or denied), and that I should not apply for any financing without JRE ' s authorization while this Agreement is in effect. RIGHT TO CANCEL: I understand that I may cancel this Agreement at any time and without penalty by sending a written cancellation request via e-mail to [email protected] and that my cancellation request will be effective when JRE confirms receipt of my cancellation request. CLIENT DISCLOSURES : I have read, understand and agree with the Client Disclosures document attached here and understand that such document is an integral part and continuation of this Agreement. This client does not have an 836 credit score as he claims in fact is score is under 750- I am not sure where on earth he would get the idea his score is over 850 considering it doesn't go over 850 anyway and not many consumers get over 805- In addition This client is failing to add that he was unreasonable in his request and that he refused our assistance and requested we stop- How can I effectivley assist him if he won't help himself? Clearly if this client had an 836 credit score he would not need our expert assistance and he could have walked into any banks and just told them to give him the loan- Not the case for this client he had many issues starting with the fact that his credit score was no where near 800 let alone 836 and that he had other issues such as no business credit profile yet he claimed to be incorporated, I was unable to locate his secretary of state certificate of good standing- with all of these issues the banks simply will not give you 100K for a business you cannot prove is even on the up and up and he expected us to jump over the same hurdles clearly he had tried to get over himself- He is simply not a pleasant person, clearly expects to much for too little and is very difficult to work with. Still do not know why he is complaining- We worked very hard to try and please a person who cannot be pleased, I dont think he should be rewarded for this and certainly do not feel as if we should refund him when he clearly violates his contract and cancels his file without following through as outlined by his contract. I am not sure why this client is complaining- Other than we attempted to assist him and he refused our help- We tried to assist him in submitting to 6 lenders and he refused each and every loan stating he wanted nothing more than 100K per submission- We attempted to advise this client that the banks do not lend this way and that he needed to work with us so we could assist him but he flat out refused: He violated his contract on at least 10 seperate occassions when he refused to follow through on his loans and then he had the nerve to ask for a refund after all of the work we did on his file. He sent me rude and intimidating emails and left very harsh voicemails- His file was cancelled as he requested and we stopped working on it. His contract clearly states that he MUST follow through on his submissions and he did not do that- It also states the requirments to recieve his refund, but since he violated so many terms of his contract he did not qualify. Again not sure why he is so upset.
