This is a follow-up to the veteran who lost his deposit at Factory Expo Home Center / Alma Cima Corp. I wrote a check for $7,000 downpayment in early Oct. 2013 and received routing numbers for their BOA account so that I could electronically submit balance of $27,000 to their account BEFORE the unit construction was ever started. In other words, they wanted ALL PAYMENT UP FRONT prior to any quality control or inspection of the final unit by the buyer. REALLY!! I was fool enough to write the downpayment but that was it!! After a few hours contemplation I IMMEDIATELY sent a letter cancelling the order and requesting a total REFUND of the $7,000. This earnest money is supposed to go into a TRUST ACCOUNT in ESCROW at their Title Co. (which is who-o-o-o??). After submitting a formal complaint to both The Office of Manufactured Housing AND the ATTORNEY GENERAL CONSUMER FRAUD DEPT. I finally received all but $495 back. The next step per my attorney was to file SUIT in Maricopa Civil Court. A real pain, but somehow the check was ent out unknown to the buyer on 1/15/14 $ MONTHS after the request. They, of course, claimed that they knew nothing about the cancellation of the order after 3 Certified letters (with documented proof of delivery from USPS). I am now researching Az Statute 41-2151 regarding refund policy of the downpayment and seeking the $495 balance to be refunded. TOO MUCH WORK!!!
