My home loan was sold to Fairbanks from Citicorp. Fairbanks has increased my payments by $300.00, claiming to be applying it to the amount owed to escrow for back taxes which should have been paid by the original lender per our contract. I have only been paying the correct payment, not the extra $300.00. I have tried several times to get Fairbanks to correct this without success.

I have hired a lawyer to try to help me clear this up. In the meantime, my attorney said to go ahead and pay the escrow, which I did, but Fairbanks misapplied it to late fees and back payments, which I did not owe. They have also tried the "No Insurance" scam on me. I have tried to speak to a manager or someone with authority. I have received letters with people's names on it who cannot be reached by phone.

They are currently showing me eight months behind on my credit report. I just found this website and am informing my attorney. I appreciate everyone who has reported on this company, because I thought it was just me who was getting scammed.

consumers do have rights when mortgages transfer. Both the old and new lender are required to give you contact information. Fred-- I believe you are referring to a specific RESPA guideline. You can look it up on the HUD webpage (www.hud.gov) under "RESPA" and see how to word your letter. There is some specific format in which to word your request for the information. If the lender does not comply, you can file a complaint with HUD. File a complaint with their regulating agencies as well. There are many predatory tactics out there, do a search under "predatory lending" and see for yourself. With interest rates so low, banks and all financial institutions are thinking up all kinds of sleazy ways to try and stay profitable in this economy. Don't be a victim! Good luck on your matter.

Fairbanks Rude Rip Offs, dosn't honor RSPA request

I have been through it with Conti & Fairbanks for 4 years now. I did stop them from calling by writting a demand letter that they stop. I only corrisponde in writting and keep copies of everything. I went to legal aide and was told they were illegally charging me corporate fees now adding up to several thousand dollars. I was instructed to write Fairbanks demanding the moneys be refunded as per my rights under RSPA. Fairbanks wrote back they had received my letter and would respond within 60 working days. That letter was dated Sep,6 2002. I went back to legal aide and was told I would have to hire a lawyer they were to busy. Fairbanks (Conti) have tried everyway to take my house, I have been called names, hung up on, called at work and at home numeerous times on the same day. One instance on the third phone call a women claiming to Robin, started screaming "please don't make your payment so we can take your house" I complained to the State Corporation Commission, Fairbankd responded by denying all wrong doing. If anybody out there knows what else can be done to these crooks let me know I want to help.
