Yes you have it right. We have that Sucker on our forehead too! Where's all our money? Escrow account paid $2000 in two month! All we pay is insurance on mortgage and lots of late charges.

Fairbanks Capital Corp.sent paperwork with amount due and dated Jan. 16 and allowed us by law 30 to reply But we received paper Jan 27, 2003 They entered paperwork to court for judgement Feb. 12, 2003.What happened to our 30 days? Wow! and $3500 for lawyer fees!Plus lots of interest too.

Filed for PHFA second time.(because of loss of wages from car accident but husband is working)

Verbal arrangements for forbearance aggreement and Fairbanks Capital Corp. sent paperwork to sign but it was different from the verbal and Kalei said that we had a verbal agreement and that is what counts.So here we are with No payment arrangements and papers in the court filed! But at least we didn't sign NO papers for Fairbanks.

We do have some equity in our home too.

We're on the list to have our application checked with PHFA but we were told they have until May 27, 2003. We must do something before that or loose our home. All the lawyers want to file bankrupcy. I did enter the letter to the Judge in Berks County telling my story.

If there is a suit going on..we want to be with it!

I did talk to WBALCHANNEL TV TOO! We are from Berks County, Pa.

Linda in Ohio, I have responded to you before, and now I will try once again. The HUD OIG office in Washington D.C. is leading the criminal investigation into the business practives of Fairbanks Capital. I am assuming that you have been calling your local HUD office and have been turned away. The local HUD office in Ohio is not yet involved in the investigation. YOU NEED TO CALL THE HUD OIG OFFICE AT : 1-800-347-3735. You also need to call the FTC; 1-877-382-4357 Please understand that it is THESE AGENCIES THAT ARE LEADING THE CRIMINAL INVESTIGATION INTO THE BUSINESS PRACTICES OF FAIRBANKS CAPITAL. THEY NEED TO HEAR FROM YOU!!!! You also NEED to find a lawyer to look over your forebearance agreement, YOU COULD STILL LOSE YOUR HOME!!!!!!!! Do not assume that this "fixed" your problem, it may have made it worse. Get a lawyer, TODAY!!! As for your credit report, as I said in the previous post, you need to file a dispute with the 3 credit agencies. Do not ignore this, the false credit reporting by Fairbanks could be the most costly in the long run. Do this today, stay one step ahead of them. You should also try to contact your local news stations, Maryland, Wisconsin, New Hampshire, Pa, Calif, Utah, Texas, .....these states, (and others) have all covered the Fairbanks story recently, and will continue to do updates. Hi, Linda, I don't know if you had the opportunity to see this editorial from your home state, so I am cutting and pasting it for you: "Editorial: (OH) GOP Moderates Need to End Lending Fraud Dayton Daily News April 27, 2003 Ohio is all but a haven for unscrupulous home-mortgage lenders and brokers. No doubt was left about that when GOP lawmakers and Gov. Bob Taft put lending-industry profits ahead of consumer protections in legislation passed last year. The public was thrown a crumb, though, when these lawmakers also organized a committee to "conduct a thorough investigation of the impact of predatory lending practices." But, thus far, the initiative shouldn't be mistaken for genuine interest in stopping abusive mortgage lending in Ohio. Lawmakers allotted the committee only $1,000 and no full-time staff. State Rep. Charles "Chuck" Blasdel, R-East Liverpool, was put in charge. He's championed lenders' legislative agenda and received large campaign contributions from the industry. During the next 60 days, the study committee will conclude its work, deciding what to recommend to Gov. Taft and legislative leaders. A determined majority of the group's 15 members can strike a blow against predatory lending, even with the deck stacked against them. They owe nothing less to the public. Predatory lending is a national disgrace that amounts to outright theft by lenders and brokers from unsophisticated consumers, many of them elderly. A shameless industry will stop at nothing to protect its cash cow. Sen. Tom Roberts and Rep. Dixie Allen serve on the study committee and should be stridently outspoken in pressing for aggressive reforms. Dayton, after all -the community they represent - has been a national leader in confronting predatory lending and documenting its hideous toll of foreclosures and other hardships. Three committee members are from groups that represent consumer interests - the Ohio AARP, the Urban League, and the Coalition on Homelessness and Housing. Each organization has been in the vanguard in educating the public about unscrupulous mortgage lending practices. Then there are the study group's independent Republican members - officials willing to put the public interest ahead of partisan politics. They hold the key. Sen. Robert Spada from the Cleveland area, for example, was one of only two Republicans in the Senate who had the guts to buck his leadership and vote against anti-consumer, pro-lender legislation. Lt. Gov. Jennette Bradley also should have a progressive outlook. She had a long career on the Columbus housing authority and city council, and must understand more than most about the devastating consequences of home foreclosures. Attorney General Jim Petro, who campaigned for office promising to work for lending reforms, is represented on the committee. Now is his chance to come through. He's proposed broadening the Consumer Sales Practices Act to enable private damage suits for lending fraud, which would be an excellent step. But to be effective, this change must be part of a larger package of reforms. Thus we have the makings of a progressive majority. Rep. Blasdel now is scheduling a final series of meetings at which the committee will consider and vote on recommendations for reform. These must be well-advertised, open forums at which proposals to protect the public are thoroughly debated and discussed. The public has a vital interest in being present - and watching closely to see who on the predatory lending study committee is performing their duty." I hope that this info will help you in your search for those who can and will help you. It is also a wake-up call concerning those who are very much "pro-lender"; sounds as though some of your lawmakers were "bought and paid for" before they ran their first campaign ad. These pols need to be voted out of office ASAP; they are not working for the people of your state and the people in your state need to know these facts! Good luck to you in your ongoing fight.

Getting help from Hud! I'm No lawyer all I can do is tell you what I did. I Clicked onto Hud website and read it about your(my) state and File a complaint about your mortgage co. PHFA is helping us but you must follow all there instructions and when they sent me papers from the Berks County courts for judgements and forecloseure I had to give a reponse within so many days..the paper said a letter so I wrote a letter to the Judge and had it time stamped and I followed up with PHFA and We NEVER signed another forebearce agreement because they still wanted all the money by the same time and they told us one thing and wrote the forebearance agreement different and said "aw thats a lawyer thing" make sure you read your paper work and file some complaints on your own..WBAL TV AND WGAL TV CLICK ONTO THEIR WEBSITES AND THEY WILL HELP GET THE BALL ROLLING!I asked attorney about help and all they wanted todo was to file Bankruptcy...some websites tell you how to do it! It would have been our last! If they had paper work filed for foreclosure make sure it has been stopped! It happens so fast! Fairbanks places dirty..time for you to get tuff! They don't go by the Law!! Check all your paper work! All of it!! I want to tell you I had paperwork everywhere..I was burned out with paper work..The more you find the more you will see how they ripped you off. They can do what they want But you must stop them or sit back and they will take your Home!! Go on the Hud website and Read every link connected..Read everything and read all the Ripoff reports..they help. don't let them take your home.File your complaints! Get an attorney too!

We tried to refinance almost a year ago and we were told the same thing. Since Fairbanks is the largest loan servicer in the U.S., chances were very high that even if we did get refinanced, our loan would end up right back there again. I can't imagine a worse scenario. Out of the frying pan and back into the fire.

We are near the end of ours. We have 3 payments left to make. There is a clause in the forbearance papers that you agree to by signing, that you give up all rights, past, present and future to any legal claims or actions against Fairbanks Capital. You do not have a leg to stand on if you sign. We signed away all of our rights to any legal remedy...forever against this company, just to keep from losing our home.

linda in willard ohio here. i have ben trying for month's to get any help from hud. they only respond with we have no help for you in this matter. to contact other banking officials. if there is help through hud, please share it with everyone. WE ARE VERY UNTRUSTING WITH THE RECORD THIS COMPANY HAS. we have stopped the sale with a forbearance agreement. we make our 2nd payment on it the 15th. they still are charging those unjustified fees, insurance, and escrow amounts to our account. we had been told things would be brought up to date with our payments but so far they have the old ddates posted. this way i think they can still get the late fees. THERE HAS TO BE A WAY TO GET THIS WHOLE MESS STOPPED.. IF YOU HAVE HELP FROM HUD PLEASE PASS IT ALONG!!!!!! WILL BE FOREVER GREATFUL!!!!!!!!!! STILL FIGHTING IN WILLARD, OHIO!!!!!!!!!!!!!

We received help form PHFA(PART OF HUD). Mercy goes out to all with Fairbanks Capital Mortgage. We will still have them for our mortgage company but we heard that the people are getting re financed and mortgage being sold back to Fairbanks. We didn't get our bottom line amount due yet because our accounts had to be checked out!! Thanks for everybody help. WGAL TV is doing a great job too! Maybe Fairbanks will get kicked out of Pa.when HUD is done!

Helen, Sorry for your troubles. One thing to remember in the future: all legitimate legal business is done IN WRITING. DEMAND it in writing and believe nothing they tell you over the phone. Phone conversations are not binding and these folks are well known to be liars. Do not agree to anything in a phone conversation with them. It is my understanding that this sleazebag company does not even honor it's written agreements in a lot of cases, but having it in writing gives YOU a legal leg to stand on. Keep every piece of paper and every cancelled check. Keep the envelopes for proving the mailing dates, which often have nothing to do with the date that the correspondence was written. (This company likes to hold things in arrears, you know.)If they are writing letters and waiting two to three weeks to mail it, there goes your thirty days. It also shows a deliberate attempt on their part to deprive you of your thirty days. I am glad you contacted the judge, but don't stop there. The media is a good idea. Also, state Congressmen and Representatives. Find out who polices these companies in your state (in Arkansas it is the Arkansas Securities Dept; they received a long e-mail from me today concerning the entire list of thugs): contact that agency as well. I am trying to get these evil people in the position of NOT being able to do business in this state, period. There seems to be little or no Federal oversight available, but perhaps we can get then run out of one state at a time. When they are down to only a few states to do business in, they will then whine to the Feds. Hopefully, it will all come out then. It's a rather "backdoor" approach, but nothing else seems to be working. You are not a sucker. It is inconceivable to Americans that a business would blatantly LIE like that and actually get away with it. We are not used to it and it blindsides us. There is so little recourse with these companies; bankruptcy may be your only option unless you can miraculously get a "cease and desist" order from your state very quickly. It would be worth a try. Hurry! Contact everyone you can think of and Godspeed.
