On October 18, 2002 we wired two payments to Fairbanks Capital. The first transaction in the amount of $870.00, was applied correctly and timely, however, the second wire from in the amount of $1,850.00, to date their claim is they are unable to locate my payment.

The customer service persons at Fairbanks Capital requested documented proof of the wire transfer from my bank and I faxed the information promptly to them. From October I have been trying to get this issue resolved with Fairbanks Capital and have not been successful. I'm religated to various customer service representative and being asked to resend proof of payment. In my last conversation, I'm told that a letter was sent to me explaining that my case is under investigated, and it will take anywhere from 20 - 60 days. It is now way pass 60 days, and the issue is still unresolved.

As a result of this fisaco, Fairbanks Capital has reported 2 - 30 days late payments on my credit report and they continue to call my home at any hour of the day harassing me and my family to collect on a "past due account".

This company have applied the mortgage payments I sent to them for my November and December and have applied it to September and October payments. The additional payments I sent towards principal is being robbed to cover late charges and other fees.

I'm have now been denied refinancing of my loan by two financial institutions. It was the only derogatory reporting on my credit report that the prospective lenders were concern with.

It has been a nightmere dealing with this company, you can never get the same information from the customer service people, I have even been told by one that I do not have home owners insurance, and that I was being placed on forced insurance. He also wanted me to fax my bank statement to show proof of my payment. Then when I called and spoke to someone else, they tell me that everything is ok, and that my account is under investigation and it will take 20 - 60 days to resolve.

Companies like Fairbanks need to get a strong message from our state legistature and the people of Florida. I will be working on that.
