In 1998, I applied for and was approved for a $54,000 FHA fixed rate loan with First Community Bank of Kansas, at 6.23% interest, before I knew what had happened, my loan documents ended up in the hands of Mortgage Plus, and my FHA loan was turned into a conventional ARM loan at 9.49% interest.

I never applied for a loan with Mortgage Plus, but before I knew what had happened again, I was closing with Pinnacle Title Company of Kansas and Missouri, and my closing costs went from $1,200 to $3,150. (Note: The seller of my home ended up paying about $6,750 in closing costs on my $54,000 loan to Mortgage Plus, which collectively means the closing costs between us on the $54,000 loan was $9,900.) I filed consumer complaints with the Kansas Bank Commission, and Mortgage Plus refunded to myself as well as other debtors our closing costs.

New Century Mortgage company bought the paper, and the next thing I knew, my mortgage payment was returned to me, and the next thing I knew, New Century had sold my loan to at least 2-other entities, and the saga goes on, and now Fairbanks Captial claims to be the last owner of my loan, after Firstar Bank had filed a fradulent foreclosure action against me.

I have been forced to sue not only Fairbanks Capital Corp., but also 21 other defendants, including finanical entities, title companies, and CSC Credit Services, for fraud, RICO, TILA and RESPA violations concerning the $54,000 mortgage on my home. There are 9 finanicial entities claiming some type interest in my home.

The other entites include: Mortgage Plus, a Kansas corporation; Ocwen Financial a Florida corporation; Hutchinson Credit Union, of Kansas; First Community Bank, of Kansas; New Century Mortgage, a California corporation; The Loan Servicing Center, a Utah corporation; BNC Mortgage, a California corporation, Firstar Bank of Milwaukee, Wisconsin; U S Bank of Wisconsin; Pinnacle Title; American Land Title; Guarantee Title; Kansas Title Insurance; HUD; FHA; President George W. Bush, and Vice President Richard Chaney.

Fairbanks Capital, The Loan Servicing Center as well as Ocwen Financial have purchased homeowner's insurance policies on my home without my knowledge or approvan, and have falsely and fraudulently reported foreclosures on my credit report.

Firstar Bank filed a fraudulent foreclosure action against me last year, which I removed to Kansas Federal District Court, (the Federal court remanded the case back to State court this year) and it is pending in the Wyandotte County Kansas District Court, where I filed the 22 Defendant countersuit.

Firstar Bank has purchased title insurance on my home, and God only knows what other fraud has been going on for the past 5-years.
