On 2/25/12, I witnessed my kitchen floor was wet and when I steeped on the lamination wood water came out of the cracks. On 2/26/12 I called the plumbers and 3 hours later they found out the problem is the copper pipe coming from the dry wall of the house to the dishwasher. I stopped the water leak and removed the pipe. Monday, 2/27/12, I called my insurance company Farmers and started a claim for water damage, and today 2/29/12 a Farmers' appraiser, a Farmers' agent and inspector came to my house. They checked and took pictures. I explained what happened and they went under the house foundation since my house is a raised foundation. They said it's really wet and looks like rot on the wood of the foundation and the laminated wood flooring is wavy.

They told me this leak is a long term leak, which is not. This all happened 1-2 weeks in time at most! I purchased my house on July 31, 2011. And from the home inspection I have it written, that kitchen floor looks good and no sign of defects or wears. I told Farmers to write down for me that with their knowledge when this leak took place since they are saying long term leak. They denied writing a letter when they there by me. I even asked their inspector if this is possible of happening within 3-7 days; he said yes and the laminated wood will cripple even in a day.

Farmers denied my claim and stuck with his knowledge saying this is an on-going leak for a long period of time! They said they cover sudden burst and damage. I told them I noticed the floors wet on Saturday. I called the plumbers next day and you guys arrived 4 days later and your inspector said it's possible it can happen within 1-7 days and yet he's still saying this is on-going leak for a long period of time! Oh, yeah, and their period of long time leak is anything more then one day!  I will not stop in till i get my rights!

You said that Farmers looked at the floor and found signs of rot on/under the foundation.  was this something that was specifically checked before you bought the house in 2011?  If so you might be able to make a case but the fact that Farmers covers sudden burst damage doesn't necessarily mean they will cover a pipe that was leaking for a couple days, sudden burst damage refers to something like a pipe actually blowing out like happened in our basement a couple years ago where a "burst-proof" pipe to an outdoor spigot froze and burst sending a couple hundred gallons of water down the drywall and carpet in our basement.

Good luck with your claim but chances are your individual case isn't something that they consider sudden burst damage.  Personally i would just keep fighting it though because i would imagine that you should have some form of coverage that would apply.
