I have been a customer of Fingerhut for many years now and was never late with a payment. In fact all my payments were for more than the minimum amount due every month.

Over the summer I became sick and had to be hospitalized for an extended time. During this time I became behind in my payments to Fingerhut. I did call them and explain my situation and also said that I would get it caught up as soon as I could.

I have been making a payment to them every month. It isn't the required amount but I am trying to get many things caught up. They call me continuely throughout the day and threaten to turn my account over to a collection agency.

Each month they add a late fee to my account. I make the payment before the due date and sometimes I make more than one payment when I can still being before the due date and I am still being hit with late fees. Can they legally do this to me?

Hope, Fingerhut already decided they are not willing to work with you, or to honor your request to stop calling. Therefore, you only have one option. Change your phone# to an unlisted one. You can do this for free if you just tell the phone company you are getting obscene/threatening calls from an UNKNOWN caller. This way, when it goes to collections you are already ahead of them. That was easy.

1st thing from what I understand Fingerhut is collection on their own debt. Which means a lot of the FDCPA guidlines are not relevent to them and they do not have to Cease and Desist even if you send a letter. The suggestion that one person gave about harrassing them and using the 1 key to p them off. It does not work all they will do is continue to call. A lot of companies offer some type of insurance on accounts to put them on hold if you get sick or become disabled.

You said that despite your paying them they continue to call and harrass you, Do this. To end the harrassing phone calls, whenever they call, the instant you realize it's Fingerhut Say Loudly "You were told not to call me" Then hit and hold down the #1 button on your telephone (Hold the reciever away from your ear)and let it scream in their ear until they hang up. Then after they hang up use the *69 feature to redial that number, and when they answer again say "You were told not to call me, and again hold the #1 button down untill they again hang up. When I turned the tables on them, harrassing them, and refusing to let them harrass me, not only did they cease harrassing me, but they blocked my telephone number from calling them. A clear victory. They can only harrass you if you let them.

The part when you said "you were hospitalized and fell behind on payments" means nothing to a creditor which Fingerhut is, you agreed to meet their payment requirements when you opened the account. It doesn't matter if you pay the account on time and more than the minimum amount for 50 years, miss one payment and they start calling! The only thing you can do if you don't want them to call is to send them a cease and decist letter certified mail, but just because they stop calling doesn't mean you no longer owe the money.
