About (2.5) years ago I enrolled with Bank of America to process credit card transactions for my business. I went into the local branch and delt directlt with a branch manager about my business needs. They hooked me right up and had me sign an electronic signature on an agreement which I did not get to see or approve of and told me a representative would be in contact with me. A representative did call me and stated that my card processor was being shipped and if I had questions to call him. There was a disclosed annual fee of $95 and a monthly fee for the equipment directly debited from my bank account.

After about a year, and 6 rate increases later from Bank of America Merchant Services, I found my self paying about 8% to process credit cards when they explained to me it was 1.4%. I only did $17,000 that year in card tranactions and paid a total of $1700.00 in bank service debits for this service. Suddenly, a special charges was debited from my account by this First Data Global Leasing og $30. It caused me and overdraft fee of $35.00, my first with Bank of America, because I only used this account for clearing checks and card activity and kept a very low balance. I enquired as to why and what this fee was for. Bank of America said it was for property tax on the equipment lease that was not in the contract by required. I was told at the beginning that the $95 fee covered that tax of the lease. However, they decided to increase their fee and bill the tax in a different debit.

I checked the County records and could not find any account for First Data Global Leasing to confirm that they had paid any local property tax on my leased equipment. I suspected fruad in fee collections. About a year passed and then again they charged me another $30 fee. But this time they sent a letter stating that the fee would be taken out on the 15th of May, 2014, with my regularly scheduled fee for the lease of $5 per month. On the 15th of May, they failed to take the $30 fee out and waited to the 28th of May, which caused me another overdraft, because during which time I had cancelled my debit card and requested a new one and Bank of America froze paymrnts for 15 days and then resumed payments again so no appearent reason other than to fowl my accounting up. Them, Bank of America, send out double payment on my transaction during that time and over drew my account which caused only one overdraft, the $30 fee on the 28th which should of been processed on the 15th. So, I ask for a consideration and they refused and referred me to First Data. I closed my account because they were getting really bad about accounting and I felt they were just robbing me and sending me fee increases almost monthly.

I closed my account and sernt First Data back their equipment on theend of the 24th month of the lease. First Data, sent be a claim that the lease was for 48 months, but Bank of America indicated the lease was for 24 months. They never sent me any documents indicating that there was any 48 month lease.

After, several months of certified letters which I sent to both Bank of America and FDGL, they basically billed me monthly for a lease I did not agree to until the total reached about $00 in December 2014. Then in Janruary, a collection agency in Florida, Hunter Warfield, sent me a claim for $1500. I dened the claim with abatement and then First Data sent me copies of a lease agreement that indicated I had electronically signed a 48 month lease rather than a 24 month lease.

So, I plan to sue Bank of America, Bank of Americs Merchant Services, First Data Global Leasing and Hunter Warfield if they report and claim under the FCRA Act, because Bank of America failed to supply me with a written copy of the lease and never indicated that the lease was for 48 months.

In Kansas, there is a defamatory Per Se statue that will allow me to collect $75k minimum for damages if they defame me.

I fully intend to sue under that statue which is K.S.A. 60-209(j), (g). In addition to this contractual complaint the fruadlent property tax collection by First Data Gobal Leasing is suspect to say the lease. I suspect First Data Global Leasing is engaged in this fruadlent tax collection in an attempt to maximize their profits nationally. Originally the fee of $95 was for this purpose which included propert tax on the leased equipment. A year later suddenly, without notice, they did the debit for $30 claiming an increase in the fee scheduled had cause a need to debit additional fee of $30 for the property taxes that was originally included in the $95 fee. Both $30 fees debited were not paid to the county for the property taxes. I could not find any personal property tax account to justify this fee being removed from my account. Tax fruad is suspected. 

In addition to this conmplaint on First Data, Bank of America, did initiate this service and I never delt directly with a First Data Global Leasing representitive. Bank of America, had be sign an electronic signature which they did manipulate to any written aggrement they so choose to bind your signature too.
