We bought our house in April of 2007 and in August of 2007, My husband was inflamed with the mersa virus on his left hand and under went 2 surgeries. We sent Flagstar bank, our mortgage payment which was returned to us, because our house was in foreclosure status. (Flagstar stated they did not receive the payments). We got in contact with the loss mitigation department to see if they could help us out. The gentleman that we were speaking to was named Steve. In November of 2007, I contacted Steve again, after applying months prior for the loss mitigation, and he told me that my paperwork was at the bottom of the pile on his desk and he had lots of time to work on it, being that the sale date for auction was February 12, 2008. I continued calling him and leaving several messages, and he would never return my phone calls. After realizing that Flagstar Bank was not going to help us keep our home, we were forced to file a Chapter 13 Bankruptcy.

 

In February 2008, we filed a Chapter 13 Bankruptcy. In June we received an email from our attorneys office stating that Tiffany & Bosco sent documentation to the law office and stated that we had not been paying our mortgage. I sent in copies of the receipts from the cashiers checks that I sent to them. We did not hear anything from anyone until October of 2008. In October we received an email from the law office, again stating that we are not sending in our mortgage payments. I sent again all receipts from February through October. For some reason, I did felt that something was not right. I decided to call Citibank where the cashiers checks were drawn from, and was informed that all of the checks, dating back from February had been cashed 2 days prior to me calling.

 

February 4th, 2009 I called the law office to let him know that we received notice of the uplift stay of the home.

 

On February 16, 2009, I called the law firm to speak to Craig, because apparently my house was back in foreclosure. When I spoke to Nicole Fox in the Bankruptcy Department at Flagstar Bank, she had told me that they had not received my mortgage payments and that my January mortgage payment was in route back to me. When I told her that all the checks were cashed she told me that I would need to get copies of the cancelled checks to see which account they went to because they were not posted to my account.

 

At this point, My husband and I were extremely livid so I contacted Ray Bannister from Flagstar Bank and let him know that they needed to find my money. Also My husband faxed ALL the copies of cancelled cashiers check, both front and back, to Tiffany & Bosco which is the attorney for Flagstar Bank.

 

Flagstar Bank in turned did a loan modification for us, raised our mortgage payments by 300.00, claimed that we were in the negative in escrow account.

 

In May of 2009, A lady from Flagstar bank sent me my entire statement and she said I was never behind my account has always been in good standing.

 

GO FIGURE!!!!!!!!!!!!! I am still wanting to know  WHERE  IS MY MONEY!!!!
