My current lease term was coming up and Fletcher Jones Mercedes have been calling me for the past 3 weeks. I have informed the dealership that I have the worst experience with Mercedes Benz, and I was going to return the vehicle. I was over my mileage and I informed Fletcher Jones Mercedes In Newport Beach, California that I was going to just pay for the over mileage on the vehicle.

I went to the dealership to return the vehicle, and told Fletcher Jones that I am not interested for the 100th time. They told me that they will pay for the over mileage, if I leased another vehicle. I repeated my self over again, and again. There was so much pressure from the dealership that I ended up looking at a 2009 E350.

I informed the Sales Manager Kushman King that my girlfriend is unable to afford the payments because she is a full time student and works part time. When we leased the vehicle 2 years ago, she had a full time job so she was able to afford the payments. Kushman King said don't worry we will make her a job and income documents.

I informed Kushman King I was not comfortable with falsifying any income because it is unethical, and it is unethical to even try to put someone into something they don't even want. We were pushed to the finance department to Angel the finance manager. We told them we really don't want a car, and kept on putting pressure on us. My girlfriend had to go to work, so she ended up signing so they would get off our case.

I felt uncomfortable the whole situation to being with. I contacted the Sales Manager the next day and informed him that we are uncomfortable and the car is not being driven. Quote on Quote " Young Man you need Counseling". That was the most insulting statement I have ever heard. I decided to contact someone who can help me, and was introduced to Chris Lazan, the General Sales Manager.

I was promised that I would receive a call from the General Manager of Fletcher Jones Mercedes. I waited for 2 days, and have not received any calls. So, I decided to go the dealership because my girlfriend ended up having a nervous break down, and was hospitalized. When I went to the dealership to talk to the General Manager, I was told that he is in a meeting or even hear that he just left for the day.

I got his e-mail from his security guard, and decided to e-mail him since I couldn't get a hold of him. Below is the e-mail I receive. Please do not ever get a vehicle from Fletcher Jones Mercedes of Newport Beach, California! You will regret it! I promise you!

Hello Garth,

I understand you are a very busy man, and I have been waiting for the past 2 days for your phone call. My girlfriend is in the hospital because of your dealership. I did not think such a reputable dealership would conduct business in this manner. I was informed by Chris Lazan that I was going to receive a phone call from you but to no evail. I am disappointed in the way fletcher jones has attempted to solve this problem. I need the vehcile to be unwound, I have already informed Chris Lazan I am not going to make any payments on the vehicle.

My girlfriend was pressured and also told by Kusman King to lie about her income, which she is a full time student and works part time. It is very unethical and I wish you could put yourself our situation. All she wanted to to do is return the vehicle, and pay for the over mileage, and due your misleading staff she has experienced a nervous breakdown requiring hospitalization for a few days. I have been very patient in this matter and would greatly appreciate some assistance in recifiying this situation. Please try to understand my predicament.

In summary I just don't want the vehicle due to falsified documents. If my girlfriend really made the stated amount as income I would have no problem in keeping the car. She is currently trying to get her pharmaceutical license and cannot jeopardize this life long career due to some falsified income. Thank you for your understand in this matter and please help me.

Sincerely,

Steve ****

Mr. ****,

Thank you for your E-mail. We appreciate your girlfriend's business. We do not ever ask clients to falsify credit applications. Furthermore, this deal was negotiated over several days as you are aware. Our staff is professional, well trained and does not conduct themselves unethically. Therefore, I am not willing to rescind the transaction.

Best regards,

Garth.

Fletcher Jones Strikes Again

I am not surprised of your post in regards to Fletcher Jones Mercedes Benz in Newport Beach. I am going through a similar situation with them right now. I had been a loyal customer and even sent business their way over the past several years. My lease was coming to an end as well and they were EXTRA aggressive in pushing for another purchase or lease to help satisfy the remaining payments and fees due on our car. They called up to 3X a day pushing for the next opportunity and pushed in writing to release the remainder of our lease if we or another immediate family member purchased or leased another car. Mike McMullen was the sales rep making all of the offers and called us for months. We were unsure of what we were going to do because we needed a bigger car and already have a SUV. Plus I was getting a new job that provided a company vehicle so jumping into another car was not a step we were sure about taking. It turned out my parents were in the market for a MB and I was finally able to get them up to there to meet Mike. Mike promised us that our remaining payments and all disposition fees would be paid off with their lease or purchase so they stopped by to see what they had. Mike showed them the cars and, very similar to your situation, pushed them towards the E350, both new and used. They went through his normal BS sales pitch and eventually moved towards the sales and pricing discussions. It was then that Mike pushed them to another sales rep, Rick Kelika, who would negotiate the final deal. During the whole process, Mike assured both my parents and myself that my car would be taken care of and that "we're all family at FJMB." Boy would I hate to be a part of his family as he screwed us the second he could. Rick and my parents finished the deal up and BEFORE signing, asked Rick to ensure that my loan would be finished off. He stated that since they were past the beginning of the month that I had already made my payment so BEFORE my next payment came due, for me to come back with my car and it would all be settled. Needless to say that I brought my car back in the next week, because I live in San Diego, and no one there brought anything up of any issues. Why would they? My parents had already got a car from them so their sales were made. I was told that whatever I had agreed to would've been done and to follow up in a week or so. I didn't get the chance as MB Financial hit me with a lease turn in bill, which I sent to FJMB to take care of. It was then that Mike McMullen FORGOT about what he had pitched for 5 months and claimed that since he didn't finalize the deal, that he had no control over it. He didn't mention that he set the meeting with my parents at the time and somehow pawned them off to Rick. Rick was going to say anything to get the deal and didn't care about what Mike had pitched. I then went to their bosses who claimed that they knew nothing about it and couldnt help. Mike did call to offer us a deal though. We could redo my parents loan and throw that amount of money into their loan. In other words, have my parents pay off my lease instead of an unethical business like Fletcher Jones Mercedes Benz. Now MB Financial has sent my bill to collections and I'm taking next steps to push FJMB name everywhere. Facebook, Myspace, and sites like Twitter will help to get their bad sales practices known to as many people as possible. MB finanical has received letters and emails from me, but have yet to respond. BBB is next and I'll continue to spread the word to as many people as possible. Good thing is, I played professional sports and have a lot of connections to several media outlets and businesses throughout Southern CA. There will be people who listen and I'll be sure to send that information to local MB dealers who often lose business from SD to Fletcher Jones due to their deal making abilities. That alone will put a dent in their business as the sales reps here will be sure to use that as their sales pitch. Sad to say, it's no longer about the money. It's about the reckoning. It will cost FJMB more than the few thousand dollars that they have burned me with. Business is business and there's only one way to conduct it. ETHICALLY. In this tough market bad business spreads quickly as consumers are more cautious when making deals. Making FLetcher Jones's Unethical Business known will be sure to get their attention. Sad to say, the previous business managers there were some of the best people I ever got to know. Maybe they knew things were turning for the worse and left before this Madoff group strikes again. I wish you the best in resolving your issues, but I highly doubt they'll do the right thing and make it right. Just avoid Fletcher Jones Mercedes Benz in Newport Beach at all costs and be sure to tell others to do the same!

You may need counseling. Read your words : "I have informed the dealership that I have the worst experience with Mercedes Benz, and I was going to return the vehicle" "I repeated my self over again, and again. There was so much pressure from the dealership that I ended up looking at a 2009 E350." "I informed Kushman King I was not comfortable with falsifying any income because it is unethical, and it is unethical to even try to put someone into something they don't even want." "We told them we really don't want a car, and kept on putting pressure on us." "My girlfriend had to go to work, so she ended up signing so they would get off our case." I would highly recommend that you and your girlfriend get some assertiveness training. Unless this dealership is holding you at gunpoint, there is no logical reason why you should have not walked out. Instead, you were not only persuaded to buy a car, but your girlfriend was persuaded to commit fraud by signing a falsified loan application (it's not unethical, it's ILLEGAL). If this is the best you can do at saying "no", you need some help.
