On Friday, December 6, 2013, Fred Grant, the SVP - Director of Mortgage Lending at Peak Finance Company in Woodland Hills, California, made, what I viewed to be, a hasty and rash decision to purchase the Las Vegas based real estate company, Eco Properties.

Eco Properties was a small company of 14 independent Real Estate agents, managed by Owner/Broker, Phil Bailey.  I am a Transaction Coordinator and I was Mr. Bailey's only employee.  I was in hired, to assist and meet the needs of the 14 agents along with maintaining Broker Compliance of all our files.

On December 9, 2013, Mr. Bailey announced, to me that he sold his company, but would remain in the office for 45 days as the Broker of record for Eco Properties.  He also told me that the new owner, Fred Grant, had the intent to 'keep me on', as he would need a Transaction Coordinator for his Real Estate Division.

To my understanding, Mr. Grant, who lived out of state, had planned to expand Eco Properties to encompass Mortgage Lending and provide Title and Escrow services, all within one convenient, office location.

The last paycheck I received, for my service to the company, was on Friday December 13, 2013 for the two week period ending Friday, December 6, 2013.  Despite never seeing Mr. Grant in the office and since I was never directed to change my schedule, I continued to come into the office, Monday through Friday, and work my normal hours for the entire month of December.

On Friday, January 3, 2014, I was told I needed to be in the office early, for a mandatory meeting set up by Mr. Grant.  The content of the meeting turned out to be irrelevant to my position, but I was in attendance, nonetheless.  At the conclusion of the meeting, Mr. Grant came into my office to talk to me.  He informed me that he no longer needed me in that capacity for which I was hired and that he now considered me a ‘1099 employee'.  He stated that he had no problem giving me a dollar raise per hour and that he ‘trusted’ me to keep track of my own time and every couple weeks I was to send him an invoice with my hours and he would then pay me.  He also told me, starting the following Monday, 'not to bother coming into the office', unless I specifically needed something.

So, Monday, January 6, 2014, I did come into the office (for just 2 hours) and I did my best to tie-up any loose ends with regard to our open files.  My final day of work, Tuesday, January 7, 2014, I came into the office and sent Mr. Grant my invoice for twelve hundred, sixty seven dollars and fifty cents ($1267.50) covering the period between, December 9, 2013 through January 7, 2014.  I resent my invoice a week later, and again on Wednesday, January 15, 2014.  It wasn’t until my third request to be compensated, that he finally acknowledged my messages.  His reply on January 15th to my three requests for payment was: ‘We will deal with who owes what to whom at the end of January.’

???

Yes, you guessed it.  I received nothing at the end of January. No communication and no paycheck.  Furthermore, I didn’t even receive my W2 by the required January 31st deadline.  Also, to add insult to injury, my unemployment has yet to be approved because they can't seem to get the tax paperwork showing I was employed by Eco Properties for the fourth quarter of 2013.

It is apparent, in my opinion, that Fred Grant did not do his Due Diligence before purchasing Eco Properties and it is irresponsible and criminal that he let his error in judgment and regret affect someone else’s livelihood.

The first week of February, after learning through the Nevada Real Estate Division, that Fred Grant has now closed the company altogether, I made a final plea for payment of my wages and as I expected, received no response.

Fred Grant the SVP - Director of Mortgage Lending at Peak Finance Company in Woodland Hills, California is not an honorable man and he robbed me of $1267.50!

First Home Capital, Inc. President/CEO, Fred Grant ignored Final Judgment by the State of Nevada

President/CEO, Fred Grant of First Home Capital, Inc. ignored the Final Order and Judgment against him, by the State of Nevada, Division of Business and Industry, Office of the Labor Commissioner.

When Fred Grant refused to pay me 1 month’s worth of wages before suddenly closing the company where I worked, I went through proper channels attempting to receive my earned compensation.  After their own investigation, the Office of the Labor Commissioner ruled in my favor and entered a judgment against Mr Grant.  In their ‘Final Order’ with accrued penalties, they cited that he did not 'comply' with the 'Determination' of their office, and directed him to pay me immediately.

Fred Grant of Woodland Hills, CA, is the new President and CEO of First Home Capital, Inc. and it has been 2 months since he turned his back on his Debt to me and the State of Nevada has now sent the matter to ‘Collection’.

Meanwhile, as I remain uncompensated for an entire month’s work, I hope that others will question Fred Grants integrity also.  After all, this situation has shined a light on his lack of professional ethics in his personal business dealings, and that reflects directly on his overall character.

I have said it before, and in my experience dealing with Fred Grant, he does not demonstrate the qualities or principles of an honorable man.

Regarding the EX-employee's remarks...

When reading the ‘EX-employee’ comments, one should take into account that this was a person who went out of their way to pile on the praise and jump to the defense of Fred Grant who they’ve ‘known for over 20 years’ but then chose not to validate or give credibility to their statement by identifying him/herself as the 'author' of their own remarks.

Regardless.  Enough evidence was provided to certainly negate the EX-employee's statement and paint a pretty clear picture of what kind of man Alfred (Fred) A Grant Jr is and his complete lack of judgment and character in this situation.

The ‘Record’ was already ‘Accurate’ and ‘Straight’ and the ‘Facts’ are Indisputable

My motivation coming here was not to ‘discredit’ or ‘ruin’ Alfred A Grant’s reputation.  I just need to be paid for my service to the Company he owned.  It took my bringing this situation to a public venue & detailing the facts, just to get his attention and prompt a response.  Ridiculous it had to come to this, and considering the number of times I contacted Mr Grant, I found his 'Rebuttal' puzzling and the utmost untrue, especially since I provided my contact information every time I requested to be paid.  Similarly, his attorney Thomas C Cook was copied on many of those messages, as well. (as evidenced on the 2 attachments accompanying my RipOff Report)

Furthermore, I am aware Peak Finance was not involved in this ‘transaction’.  Peak Finance Company of Woodland Hills, CA only employs Fred Grant as their SVP Director of Mortgage Lending, and I would believe they vet their employees.  What I think is possible, is that Alfred A Grant Jr may not have turned his back on this situation as casually if it occurred where he lived and worked.  He is a Captain of Industry while I am just one of America’s hardworking middle-class.  I am no different than many people in this economy who would suffer great hardship if cheated out of a months pay.

If Mr Alfred A Grant Jr is such ‘a stand up guy’ who would ‘face any issue head on’ then I am confused why he didn’t answer to the Claim for Wages from the Office of the Labor Commission.  I was raised to believe an ‘honorable man’ pays his debts, and doesn’t let them go to ‘Collections’ even if he views them unfair or unjust.  Plain and simple.  The Department of Business and Industry, Office of the Labor Commissioner completed their investigation and in the final Judgment the ‘Respondent’ (Mr Alfred A Grant Jr) was in violation of NRS 608.016 and ‘failed to comply with the Determination’ issued by their office. To me, that is a man who ‘Shirked from his responsibilities’.  The end.

#5UPDATE EX-employee responds

Thu, February 20, 2014

I find the allegations by this employee to be not at all like the Fred Grant I have known for over 20 years. Mr. Grant has always been an honest and fair employer. If there was a difference in understanding, he has always been willing to sit down, discuss and come to an amicable resolution of the issue. He has never in the years that I have known him shriked from his responsibilities. I find Mr. Grant to be a stand up guy who would face any issue head on. If he does in fact owe this person any back pay he would surely not withhold it from her. It seems that the matter is an ownership issue. That  particular issue should be resolved before anyone starts to point blame and make an attempt to discredit or ruin a persons reputation. This persons statement is NOT a true picture of Fred Grant, an honorable man.

#6REBUTTAL Individual responds

Fri, February 14, 2014

As a rebuttal, I’d like to offer a more accurate account. I did in fact purchase S & K REO Group, LLC., dba; ECO Properties and took possession of this company on January 3, 2014. While in the office that day I paid the bills presented to me (rent and utilities). I was not made aware by the previous owners that this employee who we believe has posted this complaint, was due anything in regards to back pay or compensation. We are currently trying to contact this employee to discuss the issue; however, we are unable to locate a current phone number, email address or regular mail address for her. So if she can be reached by anyone please have her call Thomas C. Cook at 702.221.1925 to resolve this matter. NOTE: PEAK FINANCE COMPANY is not associated in any way with this transaction. It was an independent opportunity that I pursued on my own with my wife and son for our portfolio. I take issue with this employee‘s derogatory allegations of being dishonest, unscrupulous and dubious. I am requesting a retraction of these statements.
