Last I HEARD...and I stress the word "HEARD"...
When a muffler is missing or bad you "hear" the symptoms. If the car was without a muffler then you clearly HEARD the symptoms but you continued to drive the car anyway. The lack of a muffler in effect caused gases to seep into the passenger compartment because in all probability, the exhaust system was faulty...but you continued to drive the car anyway. So, if the car had no muffler when you bought it, did you even bother to test drive it BEFORE signing any paperwork????
What can you do? NOTHING! You bought the car apparently without checking it out or having your mechanic check out and you continued to drive it anyway without regard to what was very obvious...a car without a muffler!
