In 2005, I waived all of my rights to a marital property located in Pittsburgh, I contacted GMAC morgage via email asking them to remove my name off of the property. I explained to them that I had waived my rights to the property and my ex-husband retains all legal rights to the property. I was emailed back and told to file a "quick claim deed" in allegheny county and then forward that certified document along with my divorce agreement outlining who was awarded the property to them, I did just that. Then I recieve a letter from GMAC informing me that the morgage had been late several times within the past 30 days and that they could not take me through an assumption process. I then call the company spoke with someone who assure me that this would be taken care of (after the 6th or 7th attempt), and that all I had to do was fax the documents again (for the 9th or 10th time) and it would be taken care of. I then receive the same documents that I faxed to their office in the mail informing me that they could not do anything and that I was still responsible for this morgage. I have not lived in the house for over 8 years I can not buy a house of my own because of this morgage and because my ex-husband chooses to be late on the morgage there is nothing I can do about it. It is sad because most people in my position don't have money to hire an attorney and morgage companies like this make it possible for Pigs like my ex-husband continue to use the legal system to run people into the ground. I would love to sue GMAC morgage for all of the stress they have put me through during this process and the damages they are doing to my credit .

Your divorce is not the fault of the mortgage company. You are a co signer on the mortgage and co owner as far as the mortgage company is concerned. Blame your divorce lawyer for this. He/She should have never let you sign off on custody of the property without an agreement of payment or sale.
