This is so sad, just think of all the people GNS has stolen money from. Below is a letter I had to send to our credit union to try to get these two charges of $79.90 credited back to our credit card. I have lost faith in the company due to the three respresentatives I talked to, one being a supervisor. They said they never received both of my returned shipments (which I have tracking numbers for and a delivery confirmation). What a T total pain in the rear. It upsets me that these people make these huge medical promises to people, play on their hopes for wellness or to be thin and then just deceive them and take their money. Even if you're clever and you follow all their rules (like the "free trial" and then having to ship it back and send by Fex Ex, what a lie) you will still, like me, get the big screw.

My husband purchased a trial of vitamins from a company called GNS, Inc. on 03/02/09 for the amount of $3.97. This company also d/b/a Nutralane. My husband did not sign an agreement to receive multiple shipments of these same vitamins for $80 per month. He did not like the "vitamins" which he trialed and we sent them back per the packaging instructions. I called this company on April 16th to dispute another charge we received from them for an additional shipment and a charge in the amount of $79.90. I received the product that I did not order and shipped it back to them per their request using the shipping method they instructed me to use (FedEx).

I called GNS Inc. at the number they provided me in the package 303-456-5591 on April 16th, 2009. I spoke with a representative and she assured me that we would not receive any further shipments of their products and that there would be no further charges to our credit card. She also gave me a cancellation confirmation number (RLH*****).

On 05/27/09, we received yet another charge from this company with the details below. This time, we did not receive additional product. I called 05/28/09 at the same customer service number above to dispute the charge, inform them that I didn't receive additional product and I asked them to refund the amount in full. I spoke with a customer service representative and a supervisor who said that "there was nothing they could do" but, they were willing to offer me "a $39.00 credit for more product from GNS".

The problem is, we have been charged two charges of $79.90 and have no product to show for it. We sent back both shipments just as they asked us to. We looked up the company online and it is reported as a scam and a fraud alert. I will paste the link below for your review.

The problem here is, my husband is active duty in the US Air Force and is currently away on orders. We are stationed in ***** and are unable to come in the the local branch to dispute this. These charges put our account into a negative balance with a resulting NSF fee.

We are out of ideas as to recover this money and we have called this company twice to try to get our money back. My husband is away and he is unable to help make the calls. We have never had to dispute a charge on our check card but, we think it's appropriate to recover our money. Can you help us? Can you charge back these two amounts for $79.90 since we sent back both products and did not receive the other shipment.

HERE IS WHAT RIP-OFF REPORT SUGGESTS YOU DO:

Go to your bank within 60 days of the charge, or as soon as you know about the charge, don't delay, and tell them that there has been fraudulent activity within your account. Explain that you wish to file a dispute, and demand that they assist you in accordance with Federal Regulation E.

According to the majority of victims interviewed by Rip-off Report, those who immediately called their banks to dispute the charges did not get very far. Many victims got the following responses from their banks: we could not do anything for you or you waited too long; it has been more than 60 days.

If the bank is says that you have waited too long, explain to them how you called their 800 number as soon as the charges were found, and were told by the bank that nothing could be done. Remind the bank that they failed to assist you properly at the 800 #, and instead, provided you with an inadequate explanation of your right to dispute. Tell the bank that it's their fault time has expired, and since they gave you the wrong info to begin with, they will just have to deal with it, take the loss and reverse the charges.

Tell them the truth; this was unauthorized and your account was NOT to be charged! Keep emphasizing how you never authorized anything! Direct them to the hundreds of victims reports that were filed on Rip-off Report.com. And if you're at the bank, walk them over to their computer and make them go to this site! If you are on the phone with them, tell them you will wait while they access this site! Either way, be persistent!

DO NOT TAKE NO FOR AN ANSWER!

Let them know nicely, that you were advised to Report them (the Bank) and this situation to the Banking Commission in your state. Since each state has a different name for the agency/controller over banks, find that name before you call or get to the bank so you can throw it in their face. The more knowledgeable you appear to be, the further you will get.

And just continue to demand the Federal Regulation E form! The bank CAN, MUST and WILL reverse the charge! But, you must be persistent; ask to speak to the supervisor or the area manager for all the branches in the state.

Let the bank personnel know you are meeting with the media later in the day, that you would much rather they do the right thing (as most other banks have) by looking at the complaints and immediately reversing the charge(s) to your account; no matter how long ago it was. Be sure to call the Media if necessary so you are telling the truth.

If you have to, be loud (but nice) in front of other customers. If you are just calling by phone, the above tactics should still work. The bank can easily fax or mail to you the Federal Regulation E dispute form.

CHARGES TO YOUR CREDIT CARD

If the charge was to your credit card (not debit card, check card, or checking account), contact the credit card company as soon as possible to request a dispute form. Consumers usually have a little longer to dispute fraudulent credit card charges (up to 6 months), but it is better to act right away. In this type of situation, credit card disputes are usually successful since fraudulent companies often won't contest the disputed charge. In rare cases, credit card companies will review disputes, but refuse to reverse the charges. If this occurs, complain to a manager and let them know you will be filing a report here.

Remember Don't let them get away with it! Make sure they make the Rip-off Report .. The more Reports filed on a Company or individual, the more likely it is that the authorities, media and attorneys will want to take action.

Mel, We understand that you are unsatisfied with the resolution that was offered to you in regard to your order. In your statement above you explain that you were billed two charges of $79.90. With the trial offer you ordered from, if the products are not received back within the 21 day trial period you are billed $79.90. I'm not sure why you were billed twice unless two orders were placed for the same trial offer. Our 21 day trial offer does come with an autoship program; the autoshipments begin 45 days after the order is placed. Autoship orders are processed at a reduced price of $69.90 which it appears you were not billed for. As you stated above this was cancelled for you and was confirmed with a cancellation number by our representative. In regard to the trial shipments you received, if you provided tracking which confirmed delivery of your initial order to our address within your 30 day money back guarantee a refund would not be denied to you. If we received the shipments returned to us after your guarantee period we would've been unable to offer a refund. We apologize if there was any misunderstanding with our trial offer, we would like to offer a resolution however you have already pursued a dispute with your credit card company.
